The Oklahoma Advance Directive Act sits in Title 63 of the Oklahoma Statutes, and Section 3101.4 prints the form the state expects residents to use.

That form covers more ground than a living will alone. Alongside your treatment instructions, it appoints a health care proxy and records anatomical gifts, so one document handles three jobs.

One Oklahoma rule sits outside the usual pattern, and skipping it can quietly gut the document.

Who Can Sign

Anyone of sound mind who is 18 or older.

Two Witnesses Who Inherit Nothing

Section 3101.4 asks for two witnesses aged 18 or older who are not legatees, devisees, or heirs at law. Part IV of the statutory form restates the rule in the first person, adding that your witnesses cannot be relatives and cannot inherit from you.

The Nutrition and Hydration Rule

Here is the one that matters most. If you sign a form in Oklahoma other than the statutory form, Oklahoma will not treat it as authorizing the withholding or withdrawal of artificially administered nutrition or hydration, unless it specifically says so.

Saying so takes one of two shapes. Either you write the authorization in your own words, or you place it in a separate section, paragraph, or subdivision that deals only with nutrition and hydration, and then initial and sign that part separately.

So a generic out-of-state form signed in Oklahoma may leave a gap exactly where people most expect coverage.

If You Are Pregnant

If your attending physician knows you are pregnant, you will receive life-sustaining treatment and artificially administered hydration and nutrition, unless your directive specifically authorizes withholding them.

What the Act Will Not Authorize

Nothing in an Oklahoma advance directive may authorize mercy killing, assisted suicide, or euthanasia.

Two adults who inherit nothing from you. That is the short version, and it is stricter than it first sounds.

Section 3101.4 bars legatees, devisees, and heirs at law. A legatee or devisee takes under your will, while an heir at law takes if you die without one. Between them, those categories rule out most of your immediate family, whether or not you have written a will.

The statutory form tightens it further, asking each witness to confirm they are no relation of yours. So the safe choice is two people from outside your family who stand to gain nothing.

Tip: Oklahoma also makes room for religious belief. If you may not have an attending physician for reasons based on established religious beliefs or tenets, you can name someone other than your proxy to determine your lack of decisional capacity. That designation belongs in the directive itself.

1. Use the statutory form wherever possible, since a different form triggers the nutrition and hydration rule.
2. Work through the living will part, stating your wishes on life-sustaining treatment.
3. Address artificially administered nutrition and hydration directly, initialing and signing separately if your form requires it.
4. Appoint a health care proxy, or state deliberately that you are declining to name one.
5. Complete the anatomical gifts part if you want to donate your body, organs, or parts.
6. Sign in front of two witnesses aged 18 or older who inherit nothing from you.
7. Pass copies to your proxy, your physician, and your family.

The statutory form runs in four parts.

Part I is the living will. You set out whether you want life-sustaining treatment and artificially administered nutrition and hydration in the situations the form describes.

Part II appoints your health care proxy. If you leave it blank, the form treats that as a deliberate decision to decline a proxy rather than an oversight.

Part III handles anatomical gifts under the Uniform Anatomical Gift Act. You can donate your entire body, or name specific organs or body parts, and the form defines death as either irreversible cessation of circulatory and respiratory functions or irreversible cessation of all functions of the entire brain, including the brain stem.

Part IV holds the general provisions and the signatures. It restates the age rule, the witness rules, and the pregnancy provision, then carries your signature and those of your two witnesses.

Once you become a qualified patient, your proxy consults your attending physician and holds authority over treatment decisions, including life-sustaining procedures, where your directive says so.
