• Brand, maker, or designer, where known
• Materials, finish, and color

Price and Payment

State the total and how it was paid. When several pieces sell together, listing a price per item helps if the buyer later resells or insures any of them individually.

Terms of the Sale

Record what you agreed: an as-is sale, who arranges transport, a pickup deadline, and whether any deposit is refundable.

Most disputes here come down to two things: what condition the pieces were in, and who was supposed to move them.

Settle both in writing:

• Describe existing damage plainly — wear, stains, structural repairs, replaced parts
• Note whether a piece has been reupholstered, refinished, or restored
• Say who handles transport, and who pays for it
• Set a date by which the buyer must collect, and what happens if they do not
• State when risk passes, since heavy items are easiest to damage in transit

Photographs do a great deal of work here. Take them before the handover, from several angles, including any flaw you described.

Antiques and designer pieces deserve extra attention. If provenance, an original receipt, or a maker’s certificate came with an item, note that on the form and hand the paperwork over with it.

Tip: Measure doorways, stairwells, and elevators before the sale closes. A buyer who discovers a sofa will not fit is a buyer who wants their money back, and an as-is clause rarely settles that argument comfortably.

Whether a furniture bill of sale is needed, and who accepts it, depends on where you live and why you need the record. It documents a private sale rather than registering anything.

A few things to check before you sign:

• What your state’s official website says about sales tax on private sales
• What your insurer wants as proof of value for a scheduled or high-value item
• What an auction house, appraiser, or consignment shop asks to see for provenance
• Whether either party wants a notarized signature on a large transaction

Volume changes the picture. If you sell regularly, clear an estate’s contents, or transfer a business’s assets, a local attorney or an accountant can flag obligations a one-off seller would never encounter.

For an ordinary household sale, though, none of that applies. A clear description and two signatures give both sides everything they realistically need.

Sign once the item list and the condition notes are accurate, because vague descriptions are exactly what gets argued about later. Both parties should print their names, sign, and date the same copy.

Then handle the rest:

1. Give the buyer and the seller each a signed copy, printed or as a PDF.
2. Attach the photographs you took to both copies.
3. Hand over receipts, provenance documents, care instructions, and spare hardware.
4. Confirm the pickup or delivery arrangement in writing before anyone travels.
5. Keep your copy with your insurance records, where valuations get reviewed.

Notarization is unusual for this kind of sale. Even so, a high-value antique or a large business transfer sometimes calls for it, so ask the other party first and check what the notary requires.
