When Do You Need a Bill of Sale in Kansas?

A bill of sale is required or commonly used in these situations:

  • Vehicles: A bill of sale is not always necessary for a vehicle in Kansas; however, it is highly recommended for legal protection and is required in certain situations. For instance, if the vehicle title does not have space to include the purchase price or if you purchased the vehicle from a dealer, a bill of sale is needed. The official Kansas bill of sale form is TR-312.
  • Boats: Kansas does not require a bill of sale for boats, but keeping one for your records is highly recommended.
  • Trailers: An antique vehicle (35 years old or older) can be titled with a Bill of Sale to show transfer of ownership, along with a VIN inspection to confirm the vehicle has not been stolen.
  • Firearms: Not legally required, but strongly recommended to document private transfers. Seller must ensure the buyer is legally allowed to own a firearm.
  • Motorcycles: Not mandatory, but recommended for proof of transfer. May be required when the motorcycle comes from a state that does not issue titles.

Does a Kansas Bill of Sale Have to Be Notarized?

Not always.

  • Vehicles: Generally not required, but Kansas may request notarization in unusual cases (e.g., missing or incomplete information). Lien releases (TR-150) must be notarized.
  • Boats: Notarization not required.
  • Trailers: Requires notarization if a lien is involved.
  • Firearms: Not required by law.
  • Motorcycles: Not required unless used in place of a missing or antique title.

Kansas-Specific Tips and Common Scenarios

  • Sales Tax: All vehicle purchases (including motorcycles and trailers) are taxable, either by sales tax if bought in-state or compensating use tax if bought out-of-state.`
  • Vehicle Registration: Vehicle registration must be completed with the county treasurer’s office within 60 days of purchase, title assignment, or bill of sale for an antique vehicle.
  • Boat Registration: All motorized or sail-powered boats must be registered (not titled), display a Certificate of Number, and new registrations require a $42.50 fee plus the boat’s HIN.
  • Trailer Registration: Trailers must be registered unless they weigh 2,000 pounds or less (or 6,000 pounds or less for farm trailers).
  • Firearms: Kansas is a permitless carry state (open and concealed) and does not require registration of rifles, shotguns, or handguns.
