What Is an Idaho Trailer Bill of Sale?
An Idaho trailer bill of sale records a private trailer sale. The Idaho Transportation Department publishes its own version as form ITD 3738, and the certification on it is stronger than most states ask for.
How Serious Is the Selling Price on an Idaho Bill of Sale?
Serious enough to be a felony. Form ITD 3738 has the seller certify that listing a false selling price, name, or address on the form is a felony under section 49-518(5) of the Idaho Code.
The same certification covers two other things. The seller certifies the odometer reading is accurate to the best of their knowledge, and that they have disclosed to the buyer all known brands associated with the vehicle.
Understating a price to trim the tax is a common temptation on a private trailer sale. Idaho has closed that door more firmly than most.
Idaho Requirements for a Trailer Transfer
Two clocks run after an Idaho sale, one for each party, and both carry a cost for missing them.
The seller’s five days
By signing the form, the seller acknowledges they must file a release of liability statement within five days of delivering the vehicle to the buyer.
The buyer’s thirty days
On a private sale with no lienholder, the buyer files the title documents with a county assessor’s motor vehicle office within 30 days of transfer, or a $20.00 late-filing penalty applies.
Who processes it
Idaho titling happens at a county assessor’s motor vehicle office rather than a state counter, though the department also accepts filings in some circumstances.
If a lender is involved
Where a financial institution holds a lien, it may prepare the title application and file it with the department itself. Paperless Idaho titles are issued when the lienholder takes part in the state’s electronic lien and title programme.
Buying from a dealer
An Idaho dealer prepares the title application and files it within 30 days of delivery, which shifts the deadline off the buyer.
Out-of-state dealers
A dealer outside Idaho may prepare and file the application, but is not obliged to. Where they do not, the buyer files with a county motor vehicle office within the same 30 days and faces the same penalty for missing it.
Tip
Write the price you actually paid, to the dollar. The certification on the state form makes a false figure a felony rather than a paperwork error, and the buyer signs to acknowledge the seller’s certification, so both sides are attached to the number.
How to Transfer a Trailer in Idaho
Both parties have something to do, and the seller’s task comes first.
- Complete the bill of sale with the exact selling price, the identification number, and the date.
- Have the seller sign the certification and hand over the endorsed title.
- Seller files the release of liability within five days of delivering the trailer.
- Buyer takes the title, bill of sale, and identification to a county assessor’s motor vehicle office.
- File within 30 days of transfer to avoid the late-filing penalty.
Fees are set by the state and change from time to time, so confirm current amounts with the Idaho Transportation Department before you file.
What to Include in the Document
Give the identification number, the title number, the year, make, and model, the selling price, the date, and both parties’ names, addresses, and signatures.
Disclose any known brands on the title as well. The seller certifies to having done so, and a brand that surfaces later is harder to explain than one declared at the outset.
The buyer signs too, acknowledging the odometer certification and the seller’s duty to disclose brands, so read the form before signing rather than after.
