Free Kansas Trailer Bill of Sale Template

A Kansas trailer bill of sale records a private trailer sale. The Department of Revenue publishes its own version as form TR-312, and the signature block on it is a sworn statement rather than a simple acknowledgement.

Only for a 35-year-old antique. Form TR-312 reserves transfer by bill of sale for a vehicle 35 model years old or older where no Kansas title exists in the seller’s name.

The form is blunt about everything else. All other vehicles sold by or purchased from a Kansas resident must have ownership transferred by assigned title.

For an ordinary trailer, then, the bill of sale supports the transfer rather than making it. Its main job is establishing the purchase price the county treasurer taxes.

The sworn wording and the inspection rule are the two things that catch people out.

Signed under penalty of perjury

Both parties swear and affirm on form TR-312 that the stated purchase price is true and accurate under penalty of perjury, with the form noting that the law provides severe penalties for false statements under oath.

An out-of-state document triggers an inspection

Where the title came from another state, or the bill of sale is from an out-of-state owner, a vehicle inspection is required. The trailer and title go to a Kansas motor vehicle inspection station for a Motor Vehicle Examination, and the pink copy of the MVE-1 goes to the treasurer.

What goes on the back of the title

The assignment needs the purchase price, the date of sale, the odometer reading, and the printed names and signatures of both sellers and buyers. Where the title shows more than one owner joined by the word and, everyone listed has to sign.

Notarization

The Division of Vehicles does not require most title assignments, applications, and bills of sale completed within Kansas to be notarized, though it reserves the right in unusual circumstances. Lien releases and the lienholder portion of form TR-42 are the exceptions and must be notarized.

Moving into Kansas

Once a vehicle has been in Kansas for 90 days or more, including frequent absences where you intend to return, application for Kansas title and registration is required.

The application itself

Counter applications run on the Title and Registration Manual Application, form TR-212a, issued by the Division of Vehicles.

Sixty days sounds generous until an inspection lands inside it.

1. Complete the bill of sale with an accurate purchase price and date, and have both parties sign.
2. Have the seller complete the assignment on the back of the title in full.
3. If the title or bill of sale is from out of state, obtain an MVE-1 from a Kansas inspection station.
4. Take everything to the county treasurer’s motor vehicle office in the county where the trailer is garaged.
5. Apply within 60 days of purchase, since penalty is assessed on and after the 61st day.

Fees are set by the state and change from time to time, so confirm current amounts with the county treasurer before you go.

Record the year and make, the identification number, the purchase price, the date of sale, and the printed names, addresses, and signatures of both parties.

State the price exactly. Both signatures sit under a sworn affirmation that the figure is true, which makes an approximation a poor idea rather than a rounding convenience.

Keep your copy until the new title arrives in your name.
