What Is a Nebraska Trailer Bill of Sale?
A Nebraska trailer bill of sale records a private trailer sale. Nebraska issues titles at county treasurer offices rather than a state counter, and the treasurer keeps everything you present.
Does Nebraska Require a Bill of Sale for a Trailer?
One or the other, yes. Where ownership transfers, the seller must provide the buyer with either a bill of sale or a completed Department of Revenue Form 6, the Nebraska Sales/Use Tax and Tire Fee Statement for Motor Vehicle and Trailer Sales.
Form 6 is not downloadable from the motor vehicle website. It has to be obtained from the Department of Revenue or any county treasurer, which makes a bill of sale the more practical option for most private sellers.
Whichever you use, the county treasurer retains all documentation presented for title issuance, so keep your own copy before you hand anything over.
Nebraska Requirements for a Trailer Transfer
Two rules about the title itself do most of the damage when people get them wrong.
Open titles are confiscated
An open title, meaning one signed off by the seller without the purchaser’s details completed, is a violation of the law and will be confiscated by the county official, the department, or law enforcement.
One stray mark and it is mutilated
If a signature goes in the wrong place, or an alteration of any kind is made, the title counts as mutilated. The seller then has to obtain a duplicate certificate of title before the sale can proceed at all.
Thirty days and one county
A certificate of title must be obtained within 30 days of the date of purchase. For a trailer, the title is issued in the county where it has situs, meaning where it is housed most of the time.
Where there is no situs
If the trailer does not have situs in Nebraska, the certificate of title is issued in the county where the transaction was consummated instead.
Signatures must match the face
On transferring a trailer that already carries a certificate of title, all owners sign their names exactly as they appear on the face of the title.
Spouses cannot cover for each other
When transferring ownership, a husband and wife cannot sign as agent for one another, though either may sign the title application when the title is to be held jointly.
Tip
Never accept a title with your details left blank. Nebraska treats an open title as a violation of law rather than a shortcut, and the document can be seized outright, leaving you with neither the trailer’s paperwork nor an easy way to prove what you paid.
How to Title a Trailer in Nebraska
The treasurer’s office does all of it in one visit.
- Have the seller assign the title, signing exactly as their name appears on its face.
- Take a bill of sale, or a completed Form 6, from the seller.
- Complete the application for certificate of title, signed by everyone whose name will appear.
- Work out which county the trailer has situs in.
- Present everything to that county treasurer within 30 days of purchase, with the title fee.
Fees and taxes are set by the state and change from time to time, so confirm current amounts with your county treasurer before you go.
What to Include in the Document
Give the purchaser’s and seller’s names, the identification number, the date of sale, and the purchase price, with both signatures.
The price matters more than usual here, since the treasurer uses it to work out the sales tax collected at the same counter as the title fee.
Keep a copy for yourself, because the office keeps the original.
