A New Mexico trailer bill of sale records a private trailer sale. The Motor Vehicle Division publishes its own version as form MVD-10009, and gives it a specific job rather than a general one.

When the title cannot do the work. The division states that the bill of sale is used to carry out a transfer between individuals where the assignment on the reverse side of the title is incomplete.

The same applies where there is no room left on the back of a title to make another assignment. In both cases the form steps in to finish what the title started.

The plate belongs to the seller

New Mexico runs a plate-to-owner system, meaning plates are assigned to the owner rather than the vehicle. The seller removes the plate before delivery, then has 30 days to put it on another vehicle of the same class or return it.

The odometer statement has options

Mileage can be attested on the back of the title, on the bill of sale, on a separate odometer statement, or on the title and registration application. It is required on all motor vehicle title transactions except off-highway vehicles.

Inspection for anything from elsewhere

Where the title comes from another state, or the trailer has never been titled anywhere, the trailer itself must be taken to a division field office for visual inspection.

A criminal records check runs automatically

The division’s titling system checks vehicle information against the FBI’s National Crime Information Center. The result must come back clear before titling can proceed.

A steep penalty for delay

A penalty of 50 percent of the motor vehicle excise tax falls on a New Mexico resident who accepts transfer of a vehicle in the state and then fails to apply for a certificate of title.

Sell it again only after titling

The buyer has to title and register the trailer before it can be sold on to anyone else.

Gifts need an oath

Anyone claiming a trailer was received as a gift files a notarized affidavit in which donor and recipient both affirm, under oath and penalty of perjury, that it really was one.

What the odometer wording must say

Disclosures are accepted only where they meet federal standards, carrying language marking the mileage as actual, as exceeding mechanical limits, as carrying a discrepancy warning, or as exempt.

Start by looking at the back of the title, since that decides what else you need.

1. Check whether the assignment on the reverse of the title is complete and has room.
2. Where it does not, have the seller complete the bill of sale in full.
3. Agree the odometer reading and record it on one of the accepted documents.
4. Watch the seller remove the licence plate before you take delivery.
5. Take everything to a division field office, with the trailer itself if an inspection is needed.

Taxes and fees are set by the state and change from time to time, so confirm current figures with the division before you go.

Have the seller complete it rather than filling it in yourself. That is how the division describes the process, and a form completed by the wrong party invites a question at the counter.
