Does the Damage Disclosure Law Cover Trailers?
No, and the form says so plainly. Under section 39-05-17.2 of the Century Code, the damage disclosure law covers passenger cars, trucks, pickup trucks, motorcycles, and motor homes less than nine years old.
It expressly excludes all trailers, off-highway vehicles, and snowmobiles. A trailer sale therefore needs no damage or salvage disclosure statement.
That removes one form from the pile, but it also means your written description of condition is the only record of what was disclosed at the time.

The warranty of title form has limits
An assignment and warranty of title, form SFN 2877, cannot replace the title application, and cannot be used for vehicles where an odometer disclosure is required.
False statements are an offence
The title application carries a warning that anyone making a false statement on it commits an offence, so the price and description you supply carry weight.
Homemade trailers get a state number
Where a trailer was built rather than bought, you apply for a North Dakota assigned identification number. The state will not issue one to a manufactured trailer that was originally built with a manufacturer’s number.
The year is the year you title it
On a homemade trailer, the year recorded is the year the trailer is being titled and registered, not the year it was welded together.
Three forms come back together
Once the number plate arrives you affix it, then return the number application, the certificate of vehicle inspection, and a vehicle statement of ownership carrying the newly affixed number.
Identification comes too
A copy of the front and back of your driving licence, state identification card, or other government-issued photo identification goes in with the application.
North Dakota inspects the build
A certificate of vehicle inspection is part of the homemade trailer packet, confirming an official has looked at the trailer before a number is finalised.
The statement of ownership closes it
A vehicle statement of ownership records the newly affixed number and completes the file, which is why the plate has to go on before the paperwork goes back.
Tip
Describe the condition in writing even though no disclosure form applies. North Dakota lifts trailers out of the damage disclosure law entirely, which means neither party has a state form recording what was said about the trailer’s history.
How to Title a Trailer in North Dakota
One application covers title and registration together.
- Have the seller assign the title, or complete the warranty of title form where that fits.
- Write up the bill of sale, setting out the price, the date, and a full description.
- Complete the application for certificate of title and registration.
- For a homemade trailer, apply for a state assigned identification number first.
- Submit everything to the motor vehicle division with the fees due.
Fees and excise tax are set by the state and change from time to time, so confirm current figures with the department before you file.
What to Include in the Document
Give the colour, year, make, model, and body type, the identification number, the purchase price, the date, and both parties’ names, addresses, and contact details.
Add a line on condition and any known history. No state form captures that for a trailer here, so your own wording is what stands.
