A Texas trailer bill of sale records a private trailer sale. Texas handles almost all title and registration work through county tax assessor-collector offices rather than a state counter, which means your paperwork is judged locally.

Above 4,000 pounds gross weight, yes. The department states that a manufactured trailer whose gross weight exceeds 4,000 pounds must be titled.

Below that line titling is a choice rather than a duty. Titling is optional for newly assembled trailers with a gross weight of 4,000 pounds or less, and for newly assembled farm trailers up to 34,000 pounds.

Farm trailers get their own treatment again. A farm trailer of 4,000 pounds or less used primarily as a farm vehicle is exempt from title and registration requirements, though it may be titled on request.

Missing paperwork is not a shortcut

A manufactured trailer with missing paperwork cannot be registered as an assembled trailer. The homemade route is not a way around a lost certificate of origin.

The origin certificate is the birth certificate

The department describes the manufacturer’s certificate of origin as the trailer’s birth certificate, and manufacturers are required to provide one for every trailer they build.

Start at the tongue

Look on the trailer tongue for the manufacturer’s name. Where you cannot tell whether a trailer is manufactured or homemade, an auto theft law enforcement officer has to inspect it.

Signatures on the application

The completed title application must carry the original signature of the buyer, though the seller’s signature may be reproduced or faxed.

Thirty days, and the seller’s exposure

A vehicle must be titled in the buyer’s name within 30 days of the sale. Failing to transfer properly can leave the seller answering for tickets, toll violations, or worse.

Go with the buyer

The department’s own advice to sellers is to accompany the buyer to the county tax office and watch the title application get filed.

Photo identification is mandatory

Every title application must include one of the government-issued photo identification documents listed on the form itself.

Tax runs on the same clock

Sales and use tax is paid to the county tax assessor-collector within 30 days from the date of purchase, alongside the application.

Where evidence is thin

On a bonded title application the department will consider any evidence of ownership, naming a title, a bill of sale, or even a cancelled cheque.

Weight and origin between them decide almost everything that follows.

1. Establish the gross weight and whether the trailer is manufactured or assembled.
2. Collect the certificate of origin or assigned title from the seller.
3. Complete the bill of sale with the price, date and full description.
4. Complete the application for Texas title and registration, signing it yourself in original ink.
5. File at your county tax assessor-collector office within 30 days of the sale.

Tax and fees are set by the state and change from time to time, so confirm current figures with the county office before you go.

Record the year, make, and identification number, the empty and gross weights, the sale price, the date, and both parties’ names, addresses and signatures.

Keep detailed written records beyond the document itself. The department advises sellers to hold contact information for the buyer, the date of sale, and the trailer’s details.

Both parties keep a copy.
