  • At-will employment: Kentucky is an at-will state, allowing either party to end employment at any time, except in cases of discrimination, retaliation, or contractual limits.
  • Minimum wage: The state follows the federal minimum wage of $7.25/hour. Tipped employees may be paid less, but total pay must reach $7.25/hour with tips.
  • Overtime: Non-exempt employees must receive 1.5× their regular rate for hours worked over 40 per week, in line with federal law (Kentucky Revised Statutes § 337.285).
  • Meal/rest breaks: Employees are entitled to a reasonable meal period no sooner than 3 hours and no later than 5 hours into the shift, and a 10-minute rest break for every 4 hours worked (KY Rev Stat § 337.355 and KY Rev Stat §337.365).
  • Paid leave: Kentucky does not require private employers to provide paid vacation or sick leave. Policies are set by the employer, though federal FMLA applies.
  • Pay frequency: Wages must be paid at least twice per month, within 18 days of the end of the pay period (KY Rev Stat § 337.020).
  • Final pay: Upon termination, wages are due by the next normal payday or within 14 days, whichever is later (KY Rev Stat § 337.055).
  • Child labor: Minors under 18 face hour and occupation restrictions. Youths under 16 may not work before 7 a.m. or after 7 p.m. during school weeks (extended to 9 p.m. in summer) and cannot exceed 3 hours per school day or 18 per week. Work permits are required for minors.
