A Michigan employment contract is a written agreement that outlines the working relationship between an employer and an employee. Key Michigan Hiring Rules That Affect Your Contract

  • At-will employment: Michigan follows the at-will standard unless a contract or law provides otherwise. Exceptions apply for discrimination, retaliation, or violations of public policy.
  • Minimum wage: $12.48/hour as of February 21, 2025 and will increase to $13.29 in 2026. Tipped employees must earn at least $5.99/hour plus tips to meet the minimum wage.
  • Overtime: Non-exempt employees must be paid 1.5× their regular rate for hours over 40/week (Michigan Compiled Laws § 408.414a).
  • Meal/rest breaks: Workers under 18 must receive a 30-minute break if scheduled for more than five continuous hours. No break requirement for adults.
  • Paid leave: Employees earn 1 hour per 30 hours worked. Small employers ( less than 10 workers) may cap use at 40 hours/year; larger ones (11+) at 72 hours/year. Leave can be used for illness, care, domestic violence, or public health closures. Employers cannot retaliate for use.
  • Pay frequency: Wages must be paid at least twice monthly or monthly, with written notice of paydays (MI Comp L § 408.472).
  • Final pay: Wages are due on the next regular payday after termination (MI Comp L § 408.474).
  • Child labor: Minors under 18 need a work permit. Ages 14–15 face strict limits on hours; 16–17 can work longer but cannot do hazardous jobs.
    Non-competes:
  • E-signatures: Michigan recognizes electronic signatures under the Uniform Electronic Transactions Act (MI Comp L § 450.831 – 450.849).
  • Recordkeeping: Employers must retain payroll and employment records for at least 3 years.
