New York Employment Contract Template

A New York employment contract is a written agreement that outlines the terms of work between an employer and an employee. It covers job responsibilities, pay, benefits, and workplace policies. While most jobs in New York are at-will, contracts can define additional rights and obligations.

• At-will employment: New York presumes at-will employment unless otherwise stated. Exceptions exist for discrimination, retaliation, or violations of public policy.
• Minimum wage: As of January 1, 2025, the minimum wage statewide is $15.50/hour, and it will increase to $16.00 as of January 1, 2026. The minimum wage in New York City, Long Island, and Westchester is $16.50/hour.
• Overtime: Non-exempt employees must be paid 1.5× their regular rate for hours worked over 40 per week (New York Codes, Rules and Regulations § 142-2.2).
• Meal/rest breaks: Employees working shifts of more than 6 hours covering a meal period (11 AM–2 PM, 5–7 PM, or overnight) must receive at least 30 minutes off. Shorter breaks under 20 minutes must be paid. 
• Paid leave: Under the New York Paid Sick Leave Law, employers must provide between 40 and 56 hours of sick leave per year, depending on business size and revenue. Leave accrues at 1 hour per 30 hours worked. New York also requires Paid Family Leave, funded through payroll deductions, allowing up to 12 weeks of partially paid leave.
  
• Pay frequency: Manual workers must be paid weekly, while clerical and other workers must be paid at least semi-monthly unless otherwise approved (New York Labor Laws § 191).
• Final pay: All wages must be paid by the next regular payday following termination (NY Lab L § 191).
• Child labor: Minors under 18 face hour and job restrictions. Work permits are required, and hazardous occupations are prohibited.
• Non-competes: Recently banned for most employees under legislation signed in 2023 (not yet effective as of 2025, pending litigation and implementation). For now, only narrow agreements protecting trade secrets and confidential information are enforceable.
• E-signatures: Valid under New York’s Electronic Signatures and Records Act (ESRA) (New York State Tech Laws § 309).
• Recordkeeping: Employers must keep payroll and time records for at least 6 years (NY Lab Law § 195).

To stay compliant and protect both parties, draft your contract with clear terms:

1. Add party details: List employer and employee names, job title, start date, and worksite location.
2. Define job duties: Outline responsibilities, supervisor, and reporting expectations.
3. Set pay and schedule: State hourly wage or salary, overtime eligibility, and pay frequency under state law.
4. Include leave policies: Detail PTO, sick leave (40–56 hours minimum), and eligibility for Paid Family Leave.
5. Address meal breaks: Specify how meal and rest periods are handled under New York law.
6. List benefits: Outline health insurance, retirement, or other company-provided benefits.
7. Confidentiality and IP: Add clauses protecting trade secrets and ownership of employee-created work.
8. Restrictive covenants: Avoid non-compete clauses unless narrowly drafted for confidentiality or trade secrets.
9. Termination terms: Confirm New York’s at-will status unless you provide additional protections in writing.
10. Governing law and signatures: State that New York law applies and confirm that electronic signatures are valid.
