What Is a Wyoming Employment Contract?

A Wyoming employment contract is a written agreement between an employer and employee that defines job duties, pay, and workplace expectations. Wyoming follows the at-will employment rule, meaning either party can end the employment relationship at any time unless otherwise stated in a contract or collective bargaining agreement.

Key Wyoming Hiring Rules That Affect Your Contract

  • At-will employment: Employment is presumed at-will unless a written contract or policy states otherwise.
  • Minimum wage: $5.15/hour, but employers subject to the Fair Labor Standards Act (FLSA) must pay the federal minimum of $7.25. Tipped employees must receive at least $2.13/hour plus tips.
  • Overtime: Non-exempt employees must receive 1.5× pay for hours worked over 40 in a week under the federal FLSA.
  • Meal/rest breaks: No state-mandated breaks for adult employees; federal law requires short breaks under 20 minutes to be paid.
  • Paid leave: Wyoming has no state requirement for paid vacation or sick leave. Employers may set their own policies.
  • Pay frequency: Wages must be paid at least twice per month on regular paydays for employees in the railroad, mine, or refinery industries. For all other employees, there is no statewide mandate on payment of wages (Wyoming Statutes § 27-4-101).
  • Final pay: All unpaid wages must be issued within 5 business days of termination or the next regular payday, whichever comes first (WY Stat § 27-4-104).
  • Child labor: Workers under 14 cannot be employed except in limited agricultural or entertainment roles. Those under 16 may not work in hazardous jobs or during school hours without permission (WY Stat § 27-6-110).
  • Non-competes: As of July 1, 2025, most non-compete agreements have been completely banned in Wyoming. There are limited exceptions for high level executives or professionals, and for those involved in the sale of a business. WY STAT §1-23-108
  • E-signatures: Recognized under Wyoming’s Uniform Electronic Transactions Act (WY Stat § 40-21-103).
  • Recordkeeping: Employers must maintain payroll and employment records for at least 2 years under federal law.

How to Write a Wyoming Employment Contract

Follow these steps to draft a clear and compliant agreement:

  2. Define job duties: Outline responsibilities, supervisor, and work location.
  3. Set pay and schedule: Specify the rate of pay, pay periods, and any overtime policies.
  4. List benefits: Include PTO, holidays, or insurance coverage if offered.
  5. Address breaks: Clarify company policies, even though Wyoming law doesn’t mandate them.
