A Colorado eviction notice is a written document landlords must give tenants before starting the court eviction process. It explains why the tenancy is ending and gives the tenant a deadline to fix the issue or leave, as required under Colorado Revised Statutes §§ 13-40-101–123 and 13-40.1-101–110.

• 10-Day Notice to Pay Rent or Quit (CO Rev Stat § 13-40-104(1)(d)): Gives tenants ten days to pay overdue rent or move out before you can file in court. This section also specifies shorter timelines in some instances: for non-residential agreements or employer-provided housing, three days’ notice is required; for exempt residential agreements, five days’ notice is required.
• 3-Day Notice to Quit for Non-Compliance (CO Rev Stat § 13-40-107.5(4)(a)): Used for serious lease violations such as illegal activity or dangerous behavior. No option to fix the problem.
• Lease Termination Notice (CO Rev Stat § 13-40-107): For month-to-month or expiring leases. Notice periods range from 1 to 91 days based on tenancy length, with at least one day’s notice required for a tenancy of less than one week, and longer notice periods (up to 91 days) depending on duration of occupancy and whether just cause rules apply.

To complete a valid notice:

If the tenant doesn’t comply, you can file an eviction case in county court.

Colorado law allows landlords to serve eviction notices by:

• Personal delivery to the tenant or an adult at the property
• First-class mail with proper documentation
• Posting the notice at the rental property if no one is available

Keep proof of service because the court will require it if the case moves forward.

If the tenant doesn’t pay rent, fix the lease violation, or move out within the notice period, you can file a Complaint in Forcible Entry and Detainer (JDF-101) with the county court. If the court rules in your favor, it may issue a Writ of Restitution (JDF-109) so the sheriff can remove the tenant.
