Free Illinois Eviction Notice Template

An Illinois eviction notice is a legal document landlords must serve before filing an eviction lawsuit. It tells the tenant why the lease is ending, how long they have to pay overdue rent or leave, and what happens if they don’t comply. Eviction notices are governed by Article IX of the Illinois Code of Civil Procedure (735 ILCS 5/9-101 et seq.)

• 5-Day Notice to Pay Rent or Quit (735 ILCS 5/9-209): Gives tenants five days to pay past-due rent in full or vacate before the landlord can file for eviction.
• 10-Day Notice to Quit for Non-Compliance (735 ILCS 5/9-210): Used when tenants break lease terms, such as causing property damage or engaging in illegal activity. Does not require landlords to offer time to fix the violation.
• 7-Day Lease Termination Notice (Week-to-Week Tenancies) (735 ILCS 5/9-207): Ends week-to-week rental agreements upon seven days notice when there is no lease violation.
• 30-Day Lease Termination Notice (Month-to-Month or Quarter-to-Quarter) (735 ILCS 5/9-207): Required for month-to-month or quarter-to-quarter tenancies. Must be served at least 30 days before the next rental period begins.
• 60-Day Lease Termination Notice (Year-to-Year) (735 ILCS 5/9-207): For annual leases without violations, landlords must give tenants at least 60 days’ notice before the end of the lease term.

Follow these steps to complete your notice correctly:

1. Choose the correct notice type for your situation.
2. List landlord and tenant names, along with the property address.
3. State the reason for eviction if required by law.
4. Include the correct timeline for payment, lease compliance, or moving out.
5. Sign and date the notice before serving it.

Landlords can serve notices by:

• Personal delivery to the tenant
• Certified or registered mail
• Leaving the notice with someone at the property over 13 years old and mailing a copy

Always keep proof of service, as the court will require it before proceeding with eviction.

If the tenant doesn’t comply within the notice period:

• File an Eviction Complaint and Summons in the local circuit court
• The sheriff serves the tenant with court documents
• The tenant can file an Answer before the hearing date
• If the court rules for the landlord, it issues an Eviction Order allowing the sheriff to remove the tenant if they do not leave voluntarily
