Free Minnesota Eviction Notice Template

A Minnesota eviction notice is a written warning landlords must give tenants before starting the legal eviction process, known in Minnesota as an Eviction Action. It explains the reason for eviction, how long tenants have to fix the problem or move out, and follows timelines set by Minnesota Statutes Chapter 504B.

Minnesota landlords must issue the right notice based on the situation:

• Notice to Quit for Non-Payment: Used in lease agreements and outlines a specific payment deadline. It provides tenants with the opportunity to avoid legal action by paying their rent on time.
• 14-Day Notice to Quit for Non-Payment (MN Stat § 504B.135(b)): Used for tenants in at-will rental agreements who have fallen behind on rent. They have 14 days to pay or vacate before the landlord can file for eviction.
• Notice to Quit for Non-Compliance (MN Stat § 504B.285): Used when tenants violate the lease other than by non-payment of rent, such as causing property damage, creating a nuisance, or breaking occupancy limits. Minnesota law doesn’t set a specific notice period, but reasonable notice is recommended before filing in court.
• 30-Day Lease Termination Notice (MN Stat § 504B.135(a)): Used to end a month-to-month tenancy without cause. Landlords must give either 30 days or one full rental period’s notice—whichever is shorter.

Follow these steps to complete your notice correctly:

1. Select the right notice type based on the situation
2. Add the landlord’s and tenant’s names plus the rental property address
3. Include the reason for eviction if required by law
4. State the correct notice period for payment, compliance, or move-out
5. Sign and date the notice before delivering it

Minnesota law allows landlords to serve eviction notices by:

• Personal delivery to the tenant
• Mailing a copy via first-class certified mail
• Posting the notice at the rental property if the tenant cannot be reached

Keep proof of service, as it will be required if the case goes to court.

If the tenant doesn’t comply within the required timeframe:

• File an Eviction Action Complaint (Form HOU102) in District or Housing Court
• Have a process server or sheriff serve the Summons and Complaint on the tenant at least seven days before the court date
• Attend the eviction hearing; if you win, request a Writ of Recovery so law enforcement can remove the tenant if necessary
