A Missouri eviction notice is a written document landlords must give tenants before filing for eviction in court. It explains the reason for eviction, gives tenants the time allowed to fix the problem or move out, and follows the timelines set by Missouri Revised Statutes Chapters 441 and 535.

Missouri law requires landlords to use the correct notice based on the situation:

• Notice to Quit for Non-Payment (MO Rev Stat § 535.060): Used when tenants fail to pay rent. Landlords must first demand rent in writing before filing an eviction case. While state law doesn’t set a strict deadline, three to five days is commonly given.
• 10-Day Notice to Quit for Non-Compliance (MO Rev Stat § 441.040): Used for lease violations like property damage, illegal activity, or unauthorized occupants. Tenants have 10 days to vacate the premises after receiving notice
• 30-Day Lease Termination Notice (MO Rev Stat § 441.060): Ends a month-to-month tenancy without cause by giving at least 30 days’ notice before the next rental period.

Follow these steps to complete your notice correctly:

1. Select the correct notice type for your situation
2. Add landlord and tenant names plus the rental property address
3. State the reason for eviction if required by law
4. Include the correct compliance or move-out deadline
5. Sign and date the notice before serving it

Missouri law allows landlords to deliver eviction notices by:

• Handing the notice directly to the tenant
• Sending it by certified or registered mail
• Leaving it with someone of suitable age at the rental property

Always keep proof of service for your court records.

If the tenant doesn’t comply by the deadline:

• File a Petition for Rent and Possession or Unlawful Detainer Action in the county circuit court
