What Is a Montana Eviction Notice?

A Montana eviction notice is a written notice landlords must give tenants before starting an eviction case in court. It explains the reason for eviction, the deadline to fix the issue or move out, and follows timelines set by Montana Code Annotated, Title 70, Chapter 24.

When to Use Each Type of Montana Eviction Notice

Montana law requires landlords to choose the right notice based on the situation:

  • 3-Day Notice to Pay Rent or Quit (MT Code § 70-24-422(2)): Used when tenants fail to pay rent. They have three days to pay in full or leave before eviction can be filed.
  • 3-Day Notice to Quit for Non-Compliance (Unauthorized Persons or Pets) (MT Code § 70-24-422(1)(b-c)): For violations involving unauthorized occupants or pets. Tenants have three days to fix the issue or move out, if the lease allows the tenant to cure the defect.
  • 14-Day Notice to Quit for Non-Compliance (MT Code § 70-24-422(1)(b-c)): For other lease breaches, such as property damage or leaving the unit vacant. Tenants have 14 days to remedy the problem or vacate, if the lease allows the tenant the opportunity to fix the violation.
  • 30-Day Lease Termination Notice (MT Code § 70-24-441(2)): Ends a month-to-month tenancy without cause by giving at least 30 days’ written notice.

How to Write a Montana Eviction Notice

Follow these steps to complete your notice correctly:

  1. Select the correct notice type based on the reason for eviction
  2. Add landlord and tenant names and the rental property address
  3. State the reason for eviction if required by law
  4. Include the deadline for payment, compliance, or move-out
  5. Sign and date the notice before serving it

How to Serve a Montana Eviction Notice

Under Montana law, landlords can serve notices by:

  • Delivering the notice in person to the tenant
  • Posting the notice on the rental unit if the tenant cannot be located
  • Sending the notice by certified or registered mail
