What Is a New York Eviction Notice?

A New York eviction notice is a written document landlords must serve before starting a court eviction case. It explains the reason for eviction, the time tenants have to fix the issue or move out, and follows timelines set by Article 7, Real Property Actions & Proceedings of the Consolidated Laws of New York.

When to Use Each Type of New York Eviction Notice

New York requires landlords to give different notices depending on the situation. Use Document Genius to choose the correct notice type before creating your document.

  • 14-Day Notice to Pay Rent or Quit (NY Real Prop Actions L § 711(2)) – For tenants who haven’t paid rent. Gives them 14 days to pay or move out before you can file for eviction.
  • 30-Day Notice to Quit for Non-Compliance (Curable) (NY Real Prop Actions L § 753(4)) – For lease violations that can be fixed. Tenants have 30 days to correct the problem or leave.
  • 10-Day Notice to Quit for Squatting (NY Real Prop Actions L § 713) – For unauthorized occupants or squatters. Gives them 10 days to vacate before legal action starts.
  • 30-Day Lease Termination Notice (NY Real Prop Actions L § 232-a and § 232-b) – For ending a month-to-month tenancy without cause in both New York State and New York City. Requires at least 30 days’ written notice.
