Free Vermont Eviction Notice Template

A Vermont eviction notice is a written document landlords must give tenants before filing an eviction lawsuit. It explains why the tenant is being asked to leave, how much time they have to pay overdue rent, fix a lease violation, or move out, and follows the timelines in Title 12, Chapter 169 of the Vermont Statutes.

Vermont law requires different notices depending on the reason for eviction:

• 14-Day Notice to Pay Rent or Quit (9 VT Stats § 4467(a)): Used when tenants fail to pay rent. They have 14 days to pay in full or vacate before an eviction case can be filed.
• 30-Day Notice to Quit for Non-Compliance (9 VT Stats § 4467(b)(1)): For material lease violations. Tenants have 30 days to fix the issue or leave the property.
• 14-Day Notice to Quit for Illegal Activity (9 VT Stats § 4467(b)(2)): For illegal activity on the property. Tenants must move out within 14 days.
• 60-Day Lease Termination Notice (9 VT Stats § 4467(c)(1)(A)): Ends a month-to-month tenancy if the tenant has lived on the property continuously for less than two years.
• 90-Day Lease Termination Notice (9 VT Stats § 4467(c)(1)(B)): Ends a month-to-month tenancy if the tenant has lived on the property continuously for more than two years.

To prepare a valid eviction notice in Vermont:

• Select the correct notice type for your situation
• Include landlord and tenant names plus the rental property address
• State the reason for eviction if required by law
• List the legal notice period for payment, compliance, or move-out
• Sign and date the notice before serving it

Under Vermont Rules of Civil Procedure Rule 4, landlords may serve eviction notices by:

• Hand-delivering the notice to the tenant
• Leaving it with someone of suitable age at the rental unit
• Mailing it via certified or registered mail
• Posting it at the property if the tenant cannot be found

Always keep proof of service in case the eviction proceeds to court.

If the tenant doesn’t comply within the required timeframe:

1. File a Complaint for Ejectment with the Civil Division of the Superior Court.
2. The court will issue a Summons notifying the tenant of the hearing date.
3. If the landlord wins, the court grants a Writ of Possession so the sheriff can remove the tenant if necessary.
