A Wisconsin eviction notice is a written document landlords must give tenants before filing for eviction in court. It explains the reason for eviction, gives the tenant time to fix the issue or move out, and follows timelines in Wisconsin Statutes Chapter 704.

Wisconsin law requires different notice periods based on the reason for eviction and the tenant’s length of occupancy:

• 5-Day Notice to Pay Rent or Quit (WI Stat § 704.17(2)): For tenants living at the property for less than one year. They have five days to pay overdue rent or move out before the landlord can file for eviction.
• 30-Day Notice to Pay Rent or Quit (WI Stat § 704.17(3)): For tenants living at the property for over one year. They have 30 days to pay overdue rent or vacate before eviction proceedings start.
• 5-Day Notice to Quit for Non-Compliance (WI Stat § 704.17(2)(b)): For tenants with a lease under one year who violated lease terms. They have five days to fix the issue or leave the property.
• 30-Day Notice to Quit for Non-Compliance (WI Stat § 704.17(3)): For tenants with a lease over one year who violated lease terms. They have 30 days to correct the violation or move out before eviction.
• 28-Day Lease Termination Notice (WI Stat § 704.19(3)): Used to end a month-to-month lease without cause. Requires at least 28 days’ notice.

To complete your eviction notice correctly:

• Select the right notice type for your situation
• Include landlord and tenant names plus the property address
• State the reason for eviction if required by law
• Add the legal notice period for payment, compliance, or termination
• Sign and date the notice before serving it

Under Wisconsin law, landlords can serve eviction notices by:

• Hand-delivering the notice to the tenant
• Mailing it by registered or certified mail
• Posting it at the rental unit if personal service isn’t possible

Keep proof of service since the court will require it if eviction proceedings begin.

If the tenant doesn’t comply within the required time:

1. File a Summons and Complaint in the local circuit court.
2. Serve the tenant with the summons and complaint at least five days before the hearing.
3. Attend the court hearing—if you win, request a Writ of Restitution so the sheriff can remove the tenant if needed.
