A Maryland independent contractor agreement is a written contract between a business and a self-employed worker. The worker provides services without joining the payroll.

It records what they deliver, what they get paid, and who controls the work. That last point carries weight here. State agencies look at how the relationship runs day to day, so the contract supports your classification rather than deciding it.

Maryland asks you to file the contract nowhere. Instead, the rules attach to how you classify the worker and what you hand them in writing.

Written Notice in Construction and Landscaping

The Maryland Workplace Fraud Act sits at Labor and Employment sections 3-901 through 3-920. It applies specifically to construction and landscaping.

Businesses in those two industries owe every worker they treat as a contractor or exempt person a written notice. It explains what the classification means for them. According to the Maryland Department of Labor, it goes out in both English and Spanish. Employers must also post a notice in the workplace. Section 3-914 carries the requirement.

The ABC Test

For the Workplace Fraud Act and for unemployment insurance, Maryland applies what the Department of Labor calls the ABC test. A worker counts as an employee unless all three of these hold:

• The individual stays free from direction and control over how the work is done.
• The individual customarily runs an independent business or occupation of the same nature as the work.
• The work falls outside the usual course of the hiring party’s business, or outside any of its places of business.

Under the Act, an exempt person runs a business as a sole proprietor. That person employs nobody other than a parent, child, or spouse.

Recordkeeping

Section 3-914 also asks employers to keep records for at least three years. Those records cover each worker’s name, address, occupation, and classification. They also cover evidence that anyone outside the payroll genuinely is an exempt person or a contractor.

No, a signed contract does not settle it. For individuals outside landscaping and construction, the Maryland Department of Labor says plainly that an agreement declaring someone a contractor is not by itself enough to establish that fact.

So treat the document as evidence rather than proof. A Maryland independent contractor agreement holds up when the worker sets their own hours, brings their own tools, and serves other clients. Where the daily reality looks like employment, the contract will not change the outcome.

Different agencies also apply different standards. One worker can therefore land on either side of the line depending on which question gets asked. Businesses running close to that line should speak to a Maryland employment attorney before signing.

1. Describe the work in concrete terms, with deliverables and deadlines.
2. Set the fee and the payment schedule, whether per project, per milestone, or hourly.
3. Spell out that the contractor supplies their own tools and picks their own methods.
4. Collect a completed Form W-9 so you can issue a Form 1099-NEC at year end.
5. In construction or landscaping, hand over the written classification notice in English and Spanish.
6. Have both parties sign and date, then keep your records for at least three years.

Nothing goes to a state office. Once both signatures land on the page, your Maryland independent contractor agreement binds both sides.
