What the State Looks For

Three things establish contractor status here. First, the worker stays free from control or direction by the hiring agent. Second, they run an independently established business. Third, they either carry self-elected coverage or hold the certificate.

What the Contract Should Say

Hiring agents get direct guidance here. The department asks them to keep a written contract naming the work to be performed, the materials used, the start and completion dates, payment tied to the completed project, and liability for failure to complete.

That list is unusually specific. It doubles as a drafting checklist.

What Noncompliance Costs

Contractors face fines of up to $5,000 per violation. Four things trigger them: working without a valid certificate, working under a revoked or suspended one, transferring it, or misrepresenting their status.

Hiring agents face the same $5,000 ceiling per violation. That applies to exercising control that creates an employment relationship, or requiring an employee to adopt contractor status.

Amounts here are set by the state and change from time to time, so confirm them with the Montana Department of Labor and Industry before you rely on them.

Processing usually runs 10 to 15 business days, though approval or denial can take up to 30 days.
