A codicil is a written amendment that changes, adds to, or revokes part of an existing will. It updates your will, but it does not replace it.

People often use a codicil to handle a specific change, like updating an executor, revising a beneficiary, or naming a new guardian for minor child(ren), while keeping the rest of the will the same.

A codicil works best for a small, straightforward update. However, a new will may be the safer choice if your changes affect multiple sections or your situation has changed in a major way.

Use a Codicil When the Change Is Small

• Updating a beneficiary’s name: For example, a name change after marriage, or adding a single beneficiary to replace a previous one that you designated.
• Changing the executor: If your current executor can no longer serve.
• Fixing a minor error: Clarifying wording, or correcting a typo.
• Updating a guardian: If you are only changing guardians, and everything else still fits.

Consider a New Will When the Change Is Big

• Marriage, divorce, or a new child: These often affect multiple parts of an estate plan.
• Major asset changes: Buying or selling a home, starting a business, or major inheritance changes.
• Multiple updates at once: Too many codicils can be hard to follow.
• Outdated language or structure: A clean rewrite can prevent contradictions.

To be valid, a codicil usually needs to follow the same signing rules as a will, and those rules can vary by state. For example, many states require a will to be signed and witnessed by two people, and some states recognize handwritten (holographic) wills or codicils under specific conditions.

Step 1 – Review Your Current Will

Start with the most recent signed version of your will. Then write down exactly what you want to change, and what should stay the same.

Step 2 – Identify the Will You Are Amending

Your codicil should reference your existing will clearly, including the date the will was signed. If you have older codicils, note them too, so your documents do not conflict.

Step 3 – Write the Update in Plain, Specific Language

State the change as directly as possible. For example:

• Replace a role: Removing one executor and naming a new one.
• Add or remove a provision: Adding a gift, or deleting a section.
• Modify an existing provision: Changing how a specific item is distributed.

Avoid vague wording. If the meaning is unclear, a court may default back to your original will for that section.

Step 4 – Sign With the Right Formalities

Many states require you to sign your codicil in front of witnesses, similar to signing a will. Your codicil may not be valid if it is not signed and executed in the same manner as the will itself. A common rule is two witnesses who watch you sign (or watch you acknowledge your signature).

In some situations, you may also use a notarized affidavit to help “self-prove” the will or codicil, which can make probate smoother. Whether that is available depends on your state.

Step 5 – Store the Codicil With Your Will

Keep the signed codicil with your original will, in the same safe location. If your executor cannot find the codicil, they may follow the older version of your will instead.

You can often create a valid codicil on your own if the change is simple and you follow your state’s signing rules.

• Your update is complex: Multiple changes, blended families, or disputed inheritances.
• Your will is older: You are unsure whether it still fits current rules and your current wishes.
• You expect conflict: Family disagreements can lead to challenges, even with clear documents.
