Free North Carolina Month-to-Month Rental Agreement Template

A North Carolina month-to-month rental agreement covers a tenancy that runs from period to period rather than for a fixed term. Ending one is governed by section 42-14 of the General Statutes, headed Notice to quit in certain tenancies.

The whole rule fits in two sentences of statute, and the second of those two sentences is where people come unstuck.

The statute sets a ladder of notice periods by tenancy type, then carves out one situation entirely.

Seven Days for a Month-to-Month Tenancy

A tenancy from month to month may be terminated by a notice to quit of seven days. That is among the shortest notice periods in the country, and it is short enough that people arriving from other states routinely assume it must be longer.

The Other Rungs on the Ladder

A tenancy from year to year may be terminated by a notice to quit given one month or more before the end of the current year of the tenancy. A tenancy from week to week takes two days.

The month-to-month period is described in the statute as a like notice, which ties the seven days to the same structure: it runs before the end of the current period rather than forward from the day the notice is written.

Manufactured Home Spaces Take Sixty Days

Here is the carve-out. Where the tenancy involves only the rental of a space for a manufactured home, a notice to quit must be given at least 60 days before the end of the current rental period, regardless of the term of the tenancy.

Read that last clause carefully. Regardless of the term means the sixty days applies even to a month-to-month arrangement, so the ordinary seven-day figure is wrong by more than eight times over in this situation. What matters is whether the tenant owns the home and rents only the ground it sits on.

Tip: Notice periods here are statutory and can change, so confirm the current text of section 42-14 before relying on a figure.

Seven days, given before the end of the current rental period, and either side may give it.

Because the period is measured against the end of the rental period rather than from the date of the notice, the counting works backwards. Where the rental period runs to the last day of the month and the intention is to end on the thirtieth, the notice needs to be given seven days before that, so on or before the twenty-third.

Give it later and the tenancy does not simply end seven days after the letter. It runs on to the end of the following period instead, because the notice missed the window for the current one.

That is the practical reason a North Carolina month-to-month rental agreement should record plainly when each rental period begins and ends. Seven days leaves very little room to be vague about which period a notice is aimed at.

The seven days does not depend on giving a reason. Section 42-14 sets a period, not a justification, so no cause needs to be stated for the notice to be effective.

1. Establish whether the tenancy is a dwelling let or only a space for a manufactured home, since that changes seven days into sixty.
2. Identify the last day of the current rental period.
3. Count back seven days from that day and give the notice on or before it.
4. Put the notice in writing and name the date the tenancy ends.
5. Keep proof of how and when it was delivered, because a few days decide which period it lands in.
6. Where the arrangement is week-to-week instead, use two days; where it is year-to-year, one month or more before the end of the current year.

For a North Carolina month-to-month rental agreement, the terms worth setting down are:

• The date each rental period begins and ends, since notice is measured against it
• Whether the let is of a dwelling or only of a space for a manufactured home
• The rent, the day it falls due, and how it is paid
• The address each party will accept written notices at
• Which utilities and services each side is responsible for
