Free Alabama Rent-to-Own Contract Template

An Alabama rent-to-own contract pairs a lease with a right to buy the property later, usually written as an option in the renter’s favor.

Alabama does not regulate the arrangement as a single named transaction. What it does instead is put hard outside limits on how long the buying half can stay open, and those limits bite hardest on a document that leaves dates blank.

An Alabama rent-to-own contract runs into two sections of the Code of Alabama that most template forms never mention. Both attach time limits, so confirm the current text before you rely on a date.

Silence Sets the Deed Deadline at One Year

Section 35-4-75(a) fills a gap that drafts leave open all the time. Where a contract for the sale of any interest in land, or an extension of one, fails to state the time within which or the circumstances under which a deed is to be delivered, the time for delivery becomes a reasonable time after the date the contract was entered into, and in no case more than one year after that date.

Leave the closing date out and you have not created an open-ended arrangement. You have created a one-year one.

A Recorded Contract Can Be Presumed Abandoned

Section 35-4-75(b) protects third parties from paperwork that has gone stale on the record. Where a contract for the sale of an interest in land has been recorded or rerecorded and five years have passed since the delivery time set by the parties or by subsection (a), whichever period is longer, with no action brought for specific performance, for foreclosure of the vendee’s interest, or to enforce an equitable lien arising from the contract, and no lis pendens properly filed, a lienholder, a purchaser for value, or a mortgagee may conclusively presume the contract has been abandoned and that the vendee and their successors have no equitable claim against the land.

One thing switches that off. The subsection does not apply so long as the vendee or their successors in interest are in actual possession of the land.

A Recorded Option Stops Giving Notice

Section 35-4-76(b) does the same job for options. Once an option, renewal, or extension has been recorded and a year has passed since it expired according to the recorded instrument, with nothing of record showing the option was exercised, that instrument stops being notice of the option and nobody is put on inquiry about it. Subsection (c) carries the same possession carve-out, so a person claiming the option who is in possession of the land is outside the rule.

That turns on whether the option is tied to the lease. Section 35-4-76(a) caps an option to purchase any interest in land at 20 years, and an option written to run longer terminates and stops being enforceable 20 years after it was created.

Two kinds of option sit outside that cap. One is an option to repurchase reserved by the grantor in a deed. The other is the one that matters here: an option limited in favor of a lessee and exercisable no later than the end of the lease term, or any extension or renewal of that term. A conventional rent-to-own, where the renter’s right to buy dies with the tenancy, falls in that exception.

The trap is the silent draft. Where the instrument creating the option places no limit on its duration and does not otherwise state the terms controlling duration, the option ceases to be enforceable two years after it was created. Not twenty. Two.

Section 35-4-76 does not apply to options created before January 31, 1972.

Tip: Either tie the option to the lease term or write an express end date. Leaving duration blank does not buy you two decades, it buys you two years, and a renter still saving for a deposit in year three has nothing left to exercise.

The drafting choices come first, because they are what the statutes measure.

1. Decide whether the right to buy ends with the lease. If it does, say so, and match it to any renewal or extension.
2. Give the option an express duration if it is not tied to the lease term, so the two-year default never applies.
3. Name the date the deed is to be delivered, or the circumstances that trigger delivery.
4. Have the parties sign and date, and keep a full copy with every attachment.
5. If the agreement or option goes on the public record, diary the dates, since a recorded option stops giving notice a year after it expires.

Possession runs through both sections as the thing that preserves a claim, so a renter should not give up occupancy casually while a purchase right is still live.

Beyond rent and term, these are the items in an Alabama rent-to-own contract that state law reaches directly.

• The option’s duration — an end date, or an express link to the end of the lease and its renewals.
• The deed delivery date — the day, or the circumstances that trigger it.
• Price and any rent credit — the figure or formula, and whether payments reduce it.
• Repairs, insurance, and taxes — who carries each while the renter is still renting.

Attach anything you reference rather than paraphrasing it, and give the other side a complete copy at signing.
