Free Arkansas Rent-to-Own Contract Template

An Arkansas rent-to-own contract joins a tenancy to a right to buy the same property later, at terms the parties settle at the start.

Two general Arkansas statutes do most of the work on an arrangement like this. One decides whether anyone can enforce it at all. The other decides whether it survives the owner selling to somebody else.

Nothing about an Arkansas rent-to-own contract works on a handshake. The statute of frauds catches this document from three directions at once, and the recording statute decides how far it reaches beyond the two people who signed it.

Three Separate Reasons It Must Be in Writing

Section 4-59-101(a) says no action shall be brought on the agreements it lists unless the agreement, or some memorandum or note of it, is made in writing and signed. A rent-to-own lands on three of those limbs at the same time:

• Subsection (a)(4) covers any contract for the sale of lands, tenements, or hereditaments, or any interest in or concerning them. The right to buy is an interest concerning land.
• Subsection (a)(5) covers any lease of lands for a longer term than one year, which most rent-to-own tenancies are.
• Subsection (a)(6) covers a contract that is not to be performed within one year of being made. A deal built around buying later is exactly that.

Any one of the three would be enough. Having all three apply means an oral side agreement about the purchase price, the option deadline, or a rent credit is not something a court will enforce.

Whose Signature Actually Matters

The statute does not simply require a signature. It requires the writing to be signed by the party to be charged, or by another person properly authorized by the party sought to be charged.

Read that from the enforcing side and the practical rule follows. You can only enforce against someone who signed. A document the renter signed but the owner did not leaves the renter unable to hold the owner to the sale. Both parties signing is what makes the agreement work in both directions.

That is what recording decides. Under § 14-15-404(a)(1), every deed, bond, or instrument of writing affecting the title, in law or equity, to property in Arkansas which is or may be required to be acknowledged or proved and recorded is constructive notice to all persons from the time it is filed for record with the county recorder of the proper county.

The phrase carrying the weight is “in law or equity.” A purchase right affects title in equity, so this is not a rule aimed only at deeds.

Subsection (b) supplies the consequence. An instrument for the conveyance of real estate, or by which title may be affected in law or equity, is not good or valid against a subsequent purchaser of that real estate for a valuable consideration without actual notice of it, nor against a creditor of the person who executed it who obtains a judgment or decree amounting to a lien, unless the instrument is duly executed, acknowledged or proved as required by law, and filed for record with the clerk and ex officio recorder of the county where the real estate sits.

Electronic filing counts. Under (a)(2), a document filed under the Uniform Real Property Electronic Recording Act is filed of record if it is recorded during the recorder’s regular business hours, and anything received after hours is recorded in the order received.

Tip: An unrecorded purchase right can lose to a later buyer who paid value and knew nothing about it. Recording is the step that turns a private promise into something the rest of the world has to work around.

The order here is short and the last step is the one people skip.

1. Put every term in the written document, including the price, the deadline to buy, and any rent credit, rather than leaving anything to a conversation.
2. Have both parties sign, so each can enforce against the other.
3. Get the document acknowledged or proved as the law requires for recording.
4. File it for record with the clerk and ex officio recorder of the county where the property sits.
5. Keep a complete copy, with every attachment, alongside proof of the filing date.

The filing date is what starts constructive notice running, so it is worth recording promptly rather than at the point the renter is finally ready to buy.

Beyond the ordinary rent terms, these are the points in an Arkansas rent-to-own contract that carry the weight.

• Purchase price and deadline — the figure or the formula, and the date the right to buy ends.
• Rent credits and any option fee — the amount, whether it is refundable, and whether it reduces the price.
• Signatures from both sides — the statute of frauds makes this the difference between an enforceable deal and a conversation.
• Repairs, insurance, and taxes — who pays what while the renter is still renting.

Attach anything you refer to instead of summarizing it, and give the other party a full copy at signing.
