Free California Rent-to-Own Contract Template

A California rent-to-own contract pairs an ordinary tenancy with a route to ownership. The renter occupies the property and pays rent, and separately holds the right or the obligation to buy it later.

California law recognizes more than one shape for that deal, and it does not treat any of them as a casual rental arrangement.

A California rent-to-own contract can take more than one legal form, and the state draws a line between a lease carrying a purchase option and a real property sales contract, then applies serious duties to both. Statutes are amended from time to time, so confirm anything below before you rely on it.

It Is Treated Like a Sale, Not Just a Rental

This is the point most people miss. The Civil Code article governing disclosure duties in residential sale transactions says its provisions covering residential real property of one to four dwelling units apply with equal force to leases of that property that include an option to purchase, to ground leases of land on which one to four dwelling units have been built, and to real property sales contracts as defined in Section 2985.

So the duties that attach when you sell a house attach when you rent one out with a right to buy. The same article sets a broker’s standard of care as the degree of care a reasonably prudent real estate licensee would use, measured against the knowledge required to hold a license.

The Contract and the Property Travel Together

Civil Code § 2985.1 keeps the two halves of the deal joined. A real property sales contract may not be transferred by the fee owner unless the transfer is accompanied by a transfer of the property itself, and the property may not be transferred by the fee owner unless that is accompanied by an assignment of the contract. Selling the house out from under the contract is not an option.

If it is a real property sales contract, recording is what makes it enforceable in court. The Code of Civil Procedure provides that no person or legal entity may maintain an action in any California court to enforce the terms of a real property sales contract as defined in Civil Code Section 2985, where the agreement provides for a change in ownership of real property, until one of two things has happened:

• The agreement has been duly recorded by the county recorder, or
• The change-in-ownership statement required by Section 480 of the Revenue and Taxation Code has been filed as that section provides.

The rule reaches agreements entered into after January 1, 1986, and the same provision applies to conditional sale contracts on mobilehomes subject to local property taxation.

Read plainly, an unrecorded contract is not void, but it will not get you through a courtroom door until you fix the omission. That turns recording from housekeeping into the step that protects the deal.

Tip: Handle recording at signing rather than when something goes wrong. A buyer who has paid for two years and a seller who wants to enforce are both worse off discovering the gap at the point of dispute.

Getting the paperwork done in the right order keeps the enforcement route open.

1. Settle which structure you are using, since a lease with an option and a real property sales contract are handled differently.
2. Write the purchase price or the formula that produces it, along with the deadline for buying.
3. Complete the disclosures that a residential sale of the property would require, because the Civil Code applies them to these arrangements too.
4. Have both parties sign and date the agreement, and keep a full copy with every attachment.
5. Record the agreement with the county recorder for the county where the property sits, or file the change-in-ownership statement.

A California real estate attorney is worth a call before signing, particularly where the arrangement is a real property sales contract rather than a simple option.

Alongside the rent terms, a few items in a California rent-to-own contract decide whether the deal holds up.

• Price and deadline — the figure or the formula, and the date the right to buy expires.
• Option fee and rent credits — how much, whether refundable, and whether it comes off the price.
• Maintenance, insurance, and property taxes — who carries each while the renter is still renting.
• Recording — say which party records the agreement and by when.

Attach every document you refer to instead of summarizing it, and give the other side a complete copy on the day you sign.
