A Connecticut rent-to-own contract combines a tenancy with a right to buy the same property later, usually as a lease carrying a purchase option.

Connecticut is unusually direct about this arrangement. Its main seller disclosure law names a lease containing a purchase option by description, so the duty attaches to your document rather than only to a conventional sale.

The rule that shapes a Connecticut rent-to-own contract is the Uniform Property Condition Disclosure Act, at section 20-327b of the General Statutes. The Department of Consumer Protection publishes the form it requires.

The Report Comes Before the Signature

Under the Act, the seller of residential property must give the prospective purchaser a Residential Property Condition Report before that purchaser executes any binder, contract to purchase, option, or lease containing a purchase option.

That last phrase is what pulls this document in. The trigger is not closing and it is not the deed. It is the moment the renter signs the paperwork carrying the option, so the report has to be in their hands before that.

Which Properties It Reaches

The provisions apply to transfers of residential real property of four dwelling units or less, including cooperatives and condominiums. They apply whether or not a licensed broker or salesperson is involved, so selling privately does not remove the duty.

You Have to Complete It Yourself

The form’s instructions to sellers are explicit that a real estate licensee cannot complete the report on the seller’s behalf. The seller must answer every question to the best of their knowledge and disclose any problems regarding the property.

A separate note on the form records that it does not relieve a broker of the obligation under section 20-328-5a of the Regulations of Connecticut State Agencies to disclose material facts, and that failing to do so could bring fines, suspension, or revocation of the broker’s license.

A Second Report for Some Properties

Connecticut also has a Residential Foundation Condition Report. It must be completed for residential property in a town the Capitol Region Council of Governments has determined to be affected, or potentially affected, by crumbling foundations, where the property was acquired by a political subdivision of the state, a judgment of strict foreclosure, foreclosure by sale, or a deed in lieu of foreclosure. It asks about pyrrhotite and about damage, deterioration, or repairs to a concrete foundation, and it carries the same pre-signature timing.

It costs the seller $500. Under section 20-327c, a seller who fails to furnish the report is required to credit the purchaser with that sum at closing. The same credit applies to the foundation report where that one is required.

Two limits on the report are worth understanding before anyone relies on it. Representations the seller makes in it do not constitute a warranty to the buyer. And the report is not a substitute for inspections, tests, and other methods of determining the physical condition of the property.

The form pushes buyers toward their own diligence in several places. It urges the buyer to inspect the property and, if desired, to have it inspected by an expert, recommends a licensed home inspector, and notes that a concrete foundation may be inspected by a licensed professional engineer who is a structural engineer. It also points buyers to the municipal building official to confirm that building permits and certificates of occupancy were issued.

Tip: In a rent-to-own the option often gets signed months before anyone thinks about closing. Deliver the report at that first signing, because that is when the Act requires it, not at the end.

The disclosure step comes first, which changes the usual running order.

1. Complete the Residential Property Condition Report yourself, answering every question to the best of your knowledge.
2. Complete the Residential Foundation Condition Report as well if the property falls within that requirement.
3. Deliver the report to the renter before they sign anything carrying the purchase option.
4. Take the buyer’s signed certification acknowledging they have read and received a copy, and sign the seller’s certification yourself.
5. Sign and date the rent-to-own agreement, then keep a full copy with the signed report attached.

Attaching the signed report to the agreement keeps the proof of delivery with the document it relates to, which is where you will want it later.

Alongside the rent terms, these are the points that carry a Connecticut rent-to-own contract.

• The purchase terms — the price or the formula, and the date the option expires.
• Money paid up front — any option fee or rent credit, whether it is refundable, and how it is applied.
• Disclosure handling — record that the condition report was delivered, and attach the signed copy.
• Upkeep and outgoings — who covers repairs, insurance, and taxes during the rental period.

Attach every document you refer to rather than describing it, and give the renter a complete copy on the day of signing.
