A Hawaii rent-to-own contract combines renting a home with the right to buy it later, on terms both sides settle at the outset.

Hawaii’s mandatory seller disclosure law does not treat that as a rental arrangement to be dealt with later. It reaches the document directly, and it comes with a deadline and a way out for the buyer.

The chapter that governs a Hawaii rent-to-own contract is chapter 508D of the Hawaii Revised Statutes, Mandatory Seller Disclosures in Real Estate Transactions. Statutes change, so confirm the current text before relying on a date.

It Expressly Covers a Lease With Option to Buy

Section 508D-1 defines a real estate purchase contract as a contract, as it may be amended, by which a seller agrees to sell and a buyer agrees to buy residential real property. That definition is then written to include a deposit, receipt, offer, acceptance, or other similar agreement for the sale or lease with option to buy.

The last five words are what pull a rent-to-own into the chapter. The duty does not wait for a conventional sale contract to appear.

What Counts as Residential Real Property

The same section defines residential real property as fee simple or leasehold real property with a qualifying structure on it, and it names a residential condominium or cooperative apartment whose primary use is occupancy as a residence.

Leasehold property is expressly in scope, which matters in Hawaii more than in most states.

Recorded Restrictions Come With Documents

Section 508D-3.5 deals with recorded declarations and other recorded restrictions or conditions on the use of the property. Complying with that section fulfills the seller’s duty of disclosure of material facts relating to them.

Where the required documents are available electronically, the seller may, with the buyer’s consent, provide a written statement directing the buyer to the internet address where they sit, instead of handing over paper copies. The rescission right under that section is in addition to the rights in sections 508D-5, 508D-6, and 508D-13.

The buyer can cancel and take their deposit with them. Section 508D-5 sets two clocks and a consequence.

The first clock is the seller’s. No later than ten calendar days from acceptance of a real estate purchase contract, the seller, either directly or through the seller’s agent, must provide the disclosure statement to the buyer.

The second is the buyer’s. On receiving the disclosure statement, the buyer has fifteen calendar days. A buyer who decides to rescind must deliver written notification of that decision to the seller, directly or through the seller’s agent, within the fifteen-day period. Failing to deliver that notification inside the window is deemed an acceptance of the disclosure statement.

The money follows the decision. Any rescission made under that subsection is without loss of deposits to the buyer, and those deposits must be immediately returned.

Both periods can move. Under subsection (c) the seller and buyer may agree in writing to reduce or extend the time provided for delivery, or for examination and rescission.

Tip: Count the ten days from acceptance, not from signing something later. In a rent-to-own the paperwork often arrives in stages, and the clock starts as soon as the agreement carrying the purchase right is accepted.

The disclosure step sits inside the timeline rather than at the end, so plan for it.

1. Prepare the disclosure statement before you accept, so the ten-day clock does not catch you mid-draft.
2. Set out the price or the method for calculating it, together with the option’s expiry date.
3. Deliver the disclosure statement within ten calendar days of acceptance, directly or through your agent.
4. Provide any recorded declaration or restriction documents, or the written statement directing the buyer to them online if they consent.
5. Have both parties sign and date the agreement, and keep a full copy with the disclosure and the buyer’s receipt.

Keeping the receipt with the agreement is worth the effort, because it is the record that the fifteen-day examination period ran when you say it did.

Alongside the rent terms, these are the points that carry a Hawaii rent-to-own contract.

• The purchase terms — the price or the method for setting it, and the date the option ends.
• Money paid up front — any option fee or rent credit, whether refundable, and how it applies.
• Disclosure handling — record when the disclosure statement was delivered and received.
• Leasehold details — where the property is leasehold, the terms that come with it.
• Upkeep and outgoings — who covers maintenance, insurance, and taxes during the rental period.

Attach anything you reference rather than describing it, and keep the signed set together.
