Free North Carolina Room Rental Agreement Template

A North Carolina room rental agreement is the written contract for renting one bedroom in a shared home. Deposits are governed by the Tenant Security Deposit Act, in Article 6 of Chapter 42 of the General Statutes.

North Carolina is unusual in tying the deposit ceiling to the rhythm of the tenancy rather than to the property, which makes the rent interval the first thing to fix.

It depends on how often rent falls due. The deposit may not exceed two weeks’ rent if the tenancy is week to week, one and one-half months’ rent if it is month to month, and two months’ rent for terms greater than month to month.

For a room let on a weekly basis, that two-week figure is a genuinely low ceiling, and it is easy to breach without noticing if the arrangement started informally and rent simply settled into a weekly rhythm.

Deductions are confined to a closed list: the tenant’s possible non-payment of rent and costs for water or sewer services, damage to the premises, non-fulfilment of the rental period, unpaid bills that become a lien against the property because of the tenant’s occupancy, the costs of re-renting after a breach by the tenant, the costs of removal and storage of the tenant’s property after a summary ejectment proceeding, and court costs in connection with terminating a tenancy. A reasonable non-refundable fee for pets is dealt with separately.

Two duties bracket a North Carolina room rental agreement, one at each end.

Where the Money Sits, and Telling the Tenant

The deposit must be held in a trust account at a licensed bank or savings institution, or the landlord must furnish a bond. A trust account outside North Carolina is only permissible if the landlord provides the tenant with an adequate bond in the amount of the deposits. Within 30 days after the beginning of the lease term the landlord must tell the tenant the name and address of the bank or institution holding the deposit, or the name of the insurance company providing the bond.

Thirty Days, or Sixty If the Damage Is Complicated

The landlord must account for the deposit within 30 days after the tenancy ends and possession is delivered. Where the extent of the landlord’s claim cannot be determined within 30 days, the landlord must provide an interim accounting no later than 30 days after termination and delivery of possession, and a final accounting within 60 days.

Where the tenant’s address is unknown, the landlord applies the deposit as permitted after 30 days and holds the balance for collection by the tenant for at least six months. No part may be withheld for conditions due to normal wear and tear, and the landlord may not retain an amount exceeding actual damages.

Tip: Willful failure to comply with the deposit, bond, or notice requirements voids the landlord’s right to retain any portion of the deposit, and on a finding of willful non-compliance a court may award the tenant attorney’s fees. Figures are statutory and can change, so confirm the current text.

For a North Carolina room rental agreement, the terms worth adding are:

• Whether rent is weekly or monthly, since that sets the deposit ceiling
• The bank or bond details, which the lease is a convenient place to record
• Any non-refundable pet fee, stated separately from the deposit
• The forwarding address the accounting should go to
• Which areas are shared, and the rules for using them
