Free Montana Lease Termination Letter Template

A Montana lease termination letter is the written notice that ends a periodic tenancy under Montana Code Annotated section 70-24-441. Landlord and tenant work to the same rules here, so either side can send one. Montana also lets the tenancy end on the date you name rather than at the close of a rent period.

Two periods, both counted back from a date the notice designates.

Notice Periods

Section 70-24-441(1) lets either party end a week-to-week tenancy by written notice given at least seven days before the termination date specified in the notice. Subsection (2) covers monthly arrangements: either party may give at least 30 days’ notice in writing, at any time during the tenancy, before the date designated for termination. Notice periods get amended, so check the current section before you count.

Notice Can Go Out at Any Time

That phrase in subsection (2) does quiet work. Because notice may be given at any point during the tenancy, you are not waiting for a rent date to come round before sending it.

The Section Says Nothing About Reasons

Neither subsection asks for a cause. So neither side has to explain the decision in the notice, although a rental agreement may add terms of its own on top.

Yes, and the statute is unusually direct about it. Under section 70-24-441(3), the tenancy terminates on the date designated and without regard to the expiration of the period for which, by the terms of the tenancy, rents are to be paid.

The money follows the same logic. Unless the parties agreed otherwise, rent is uniformly apportionable from day to day, so a tenancy ending on the twelfth produces twelve days of rent for that month rather than a full month’s charge.

A Montana lease termination letter works backward from the date it designates.

1. Identify whether the tenancy runs weekly or monthly.
2. Choose the termination date, which need not fall at the end of a rent period.
3. Count back seven days for a weekly tenancy, or 30 for a monthly one.
4. Put the notice in writing and deliver it.
5. Give the landlord a new mailing address for the deposit.

Section 70-24-441 prescribes no form, so a complete Montana lease termination letter carries it.

• The address of the rental unit
• The names of the landlord and the tenant
• The date designated for termination
• Whether the tenancy runs weekly or monthly
• A new mailing address for the deposit
• Signature and date

Deposits then run under section 70-25-202. Where an inspection finds no damage, no cleaning required and no unpaid rent, and the tenant can show that no utilities remain unpaid, the landlord returns the deposit within 10 days. If the landlord does claim something, a written list of damages goes to the tenant, and section 70-24-108 governs how that list reaches them.

That new address matters more than it looks. The same section provides that it is not a wrongful withholding where a landlord mails the funds to the last-known address of a departed tenant who never supplied a new one, although the landlord stays liable to the tenant for the amount due.
