Free Rhode Island Lease Termination Letter Template

A Rhode Island lease termination letter is the written notice one side of a rental agreement gives the other to end a periodic tenancy. Under the Residential Landlord and Tenant Act, either the landlord or the tenant may send it, and § 34-18-37 sets how far ahead it has to arrive.

Because the notice ends the tenancy on a fixed date, it also fixes the last day rent is owed. That makes the date you choose the most important line in the letter.

A Rhode Island lease termination letter has to clear one of three deadlines, and which one applies depends on how often rent comes due. Section 34-18-37 sets all three, and both sides count on the same clock.

• Week-to-week — at least 10 days before the termination date named in the notice.
• Month-to-month, or any period longer than a month and shorter than a year — at least 30 days.
• Year-to-year — at least three months before the occupation year expires.

The date itself matters as much as the count. The statutory notice ends the tenancy on the first day after the current rental period closes, so pick a date that lines up with the rent cycle rather than a day partway through the month.

The Rhode Island Department of Housing’s landlord-tenant handbook puts it plainly. A notice that gives less than the required time, or that names a termination date other than the day after the last day of a rental period, has no legal effect and the other side may disregard it. Sending more notice than the minimum is always fine, though, and it gives everyone room to plan.

Very nearly. Section 34-18-37 requires the notice to be in a form substantially similar to the one printed at § 34-18-56(c), which the statute titles Notice of Termination of Tenancy. The Rhode Island District Court publishes that form for anyone who wants the official layout.

Substantially similar leaves a little room for wording. However, a letter that drops the required elements is a weaker document than one that tracks the statutory structure line for line, so match it closely.

Sending a Rhode Island lease termination letter comes down to picking the right date and keeping proof that you mailed it.

1. Confirm whether your tenancy runs week to week, month to month, or year to year.
2. Choose the termination date: the first day after your current rental period ends.
3. Count backward from that date to clear 10 days, 30 days, or three months.
4. Fill in the notice using the § 34-18-56(c) structure, then sign and date it.
5. Mail a copy by first-class mail and complete the certification of mailing.
6. Keep the signed original, the certification, and your proof of postage together.

If a tenant remains after the termination date, § 34-18-38 covers eviction for unlawfully holding over, and that case belongs in District Court.

The statutory form is short, and every line on it does a job:

• The date of mailing
• The name and address of the person receiving the notice
• The address of the rental property
• The date the tenant must vacate and deliver control of the premises
• A statement that the notice is given to terminate the tenancy
• A reminder that rent stays due until that date
• The sender’s signature, name, and address
• The certification that a copy went out by first-class mail

There is no space on the form for a reason, so a no-cause notice does not need to explain itself. Document Genius asks for each of these details in a step-by-step questionnaire and drops them into place for you.
