A Utah lease termination letter is written notice that a tenancy will end on a stated date. Landlords and tenants both use one.

Utah handles this inside its unlawful detainer statute rather than a standalone landlord-tenant act, so the notice rules sit in Utah Code § 78B-6-802. That section describes when a tenant is holding over unlawfully, and the notice periods fall out of those descriptions.

Not every ending needs a letter. Under § 78B-6-802(1)(a), a lease for a specified term is terminated without notice at the expiration of that term, whether the term was established by express or implied contract, in writing or by spoken agreement. A fixed lease that simply runs out ends on its own.

Notice becomes necessary once the arrangement has no fixed end. Section 78B-6-802(1)(b) covers real property leased for an indefinite time with monthly or other periodic rent reserved, and that is where the count begins.

Even where the statute asks for nothing, a short letter earns its few minutes. It records the move-out date and leaves both sides holding the same understanding of when rent stops and keys change hands.

For a periodic tenancy, the owner, the owner’s designated agent, or a successor in estate serves notice requiring the tenant to quit 15 calendar days or more before the end of that month or period. A tenant who stays past it is in unlawful detainer under § 78B-6-802(1)(b)(i).

Two details trip people up. The count is in calendar days rather than business days. And it runs to the end of a month or rental period, so a Utah lease termination letter should name the last day of a rent cycle instead of a date partway through one.

A breach of the lease runs on its own track. Under § 78B-6-802(1)(h), where a tenant neglects or fails to perform a condition or covenant of the lease other than those the statute lists separately, the owner serves written notice requiring in the alternative the performance of the condition or covenant or the surrender of the property. The notice goes to the tenant and to any subtenant in actual occupation, and the tenant is in unlawful detainer if it remains uncomplied with for three calendar days after service.

Where a tenant remains after the period closes, the owner’s route is an unlawful detainer action in the district court. Changing locks or removing belongings is not an alternative to filing.

Your Utah lease termination letter sets one clock running; handing back possession starts another.

Under § 57-17-3(2), no later than 30 days after the day the renter vacates and returns possession, the owner or the owner’s agent delivers the deposit balance and any prepaid rent to the renter’s last known address, or electronically by a means the renter provided, along with a written notice itemizing and explaining the reason for each deduction.

Section 57-17-3(1) limits what may come out: rent, damage to the premises beyond reasonable wear and tear, other costs and fees provided for in the contract, and cleaning of the unit.

If nothing arrives, the renter has a further step. Section 57-17-3(3) lets the renter serve the owner or the owner’s agent a notice of the failure to comply, and under subsection (5) the owner then has five business days from service to do what subsection (2) requires.

Subsection (4) sets out how that notice may be served, all of it at the address given in the lease agreement:

• Delivering a copy to the owner or the owner’s agent personally.
• Leaving a copy with a person of suitable age and discretion, where the owner or agent is absent.
• Affixing a copy in a conspicuous place, where no such person can be found.
• Sending a copy by registered or certified mail.

Statutory deadlines are amended from time to time, so confirm the current figures before you count on a date.
