Free Vermont Lease Termination Letter Template

A Vermont lease termination letter is written notice that a tenancy will end on a specific date. Either side can send one.

Vermont sets the rules at 9 V.S.A. § 4467, and the statute is unusually precise about timing. One requirement holds whichever route you take: under § 4467(f), the termination date must be specifically stated in the notice. A letter promising to end the tenancy in roughly two months has not met that.

Where there is no written rental agreement, the period scales with the length of the tenancy. Section 4467(c) lays out three:

• Rent payable monthly, tenant has resided continuously in the same premises for two years or less — at least 60 days after the date of the actual notice.
• Rent payable monthly, tenant has resided continuously for more than two years — at least 90 days.
• Rent payable weekly — at least 21 days after the date of the actual notice.

Sixty days is the floor for most monthly tenancies, not 30. That single point produces more defective Vermont lease termination letters than any other.

Notice how the count is measured. Each of these periods runs from the date of the actual notice, not backward from the end of a rent cycle, so the termination date you name has to sit that many days past the day you serve it.

A sale changes the arithmetic. Under § 4467(d), a landlord who has contracted to sell the building may terminate a tenancy by giving actual notice of a termination date at least 30 days after the date of that notice.

Written agreements run backward from the end of the term rather than forward from the notice, which is a different calculation entirely.

Section 4467(e) requires no-cause notice at least 30 days before the end or expiration of the stated term where the tenancy has continued two years or less, and at least 60 days where it has continued more than two years. A written week-to-week agreement takes at least seven days.

Serious conduct is handled apart from all of this. Where termination is based on criminal activity, illegal drug activity, or acts of violence that threaten the health or safety of other residents, § 4467(b)(2) allows a termination date at least 14 days from the date of the actual notice.

Telling the landlord your move-out date does more than close the tenancy in Vermont. It is what makes the deposit deadline bite.

Under 9 V.S.A. § 4461(c), the landlord returns the deposit with a written statement itemizing any deductions within 14 days of the date the landlord discovers the tenant vacated or abandoned the unit, or the date the tenant vacated, provided the landlord received notice from the tenant of that date. For seasonal occupancy of a unit not intended as a primary residence, the window is 60 days.

Section 4461(d) requires the statement and any payment to be hand-delivered or mailed to the tenant’s last known address. Section 4461(e) is blunt about the consequence: a landlord who fails to return the deposit with a statement within 14 days forfeits the right to withhold any portion of it.

Deductions are confined by § 4461(b) to unpaid rent, damage that is neither normal wear and tear nor the result of events beyond the tenant’s control, unpaid utility or other charges the tenant owed directly, and the cost of removing articles the tenant abandoned. Note too that under § 4461(g) a town or municipality may adopt its own security deposit ordinance, so check locally as well. Statutory periods change, so confirm the current ones before relying on a date.
