Free Wyoming Lease Termination Letter Template

A Wyoming lease termination letter is written notice that a tenancy will end on a stated date. Either party can send one.

Wyoming differs from most states here, and the difference shapes the whole page. The Residential Rental Property Act at W.S. § 1-21-1201 through § 1-21-1211 covers deposits, the condition of the unit, and remedies, but it does not set a notice period for ending a periodic tenancy. The forcible entry and detainer article that follows governs the court process, not how a tenancy is ended by agreement.

With no statutory default to fall back on, the rental agreement does the work. Read its notice clause first, because whatever it says is the rule that applies to you.

Where the agreement names a period, count from that. Where it says nothing, a clear written record of the date you gave notice matters more than it would in a state with a statutory number to point back to.

A Wyoming lease termination letter is worth sending even where nobody has asked for one. It fixes the end date in writing, marks when rent stops, and gives you something concrete to produce if the move-out date is later disputed.

Because so much rides on the individual agreement here, a local attorney is worth an hour where the tenancy is long-running, commercial, or already contested.

Staying on moves things into the forcible entry and detainer article, which does carry statutory timing.

Section 1-21-1002(a)(i) allows forcible entry and detainer proceedings against tenants holding over their terms, or after a failure to pay rent for three days after it is due.

Before filing, § 1-21-1003 requires the party bringing the action to notify the adverse party to leave the premises. That notice is served at least three days before the action begins, by leaving a written copy with the defendant, or at their usual place of abode or business if they cannot be found.

Read that as a pre-suit step rather than a way to end a tenancy. It is the notice that has to precede a court filing, not a substitute for whatever termination notice the lease calls for. The case itself goes to a circuit court under § 1-21-1001, and the summons is served not less than three nor more than twelve days before the trial date under § 1-21-1004.

Send a forwarding address with your Wyoming lease termination letter, because the deposit clock runs on two dates and uses whichever falls later.

Under § 1-21-1208(a), the balance of any deposit and prepaid rent, together with a written itemization of any deductions and the reasons for them, is delivered or mailed without interest within 30 days after termination of the rental agreement, or within 15 days after receipt of the renter’s new mailing address, whichever is later. The same subsection puts a duty on the renter too: within 30 days of termination, notify the owner or designated agent of the location where payment and notice may be made or mailed.

Deductions are limited to accrued rent, damage to the unit beyond reasonable wear and tear, the cost of cleaning the unit to the condition it was in at the start of the agreement, and other costs provided by contract.

A separately identified utilities deposit runs on its own schedule. It is refunded within 10 days of a satisfactory showing that all utility charges have been paid. Absent that showing within 45 days of termination, the owner applies the deposit to the outstanding utility debt within 15 days after, and any refund due follows within 7 days. Statutory figures change, so confirm the current ones before you rely on a date.
