A website design non-disclosure agreement protects information shared between a client and the designer, developer, or agency building their site.
Web projects sit at an awkward scale. They are often too small for a full legal process, yet the designer routinely receives hosting credentials, analytics access, customer data, pricing, and unreleased brand or campaign material.
The agreement is usually short and mutual in spirit even when one-way in form. Clients share business information; designers share their own processes, rates, and sometimes proprietary tooling.
It sits alongside the main contract rather than replacing it. Scope, payment, ownership of the finished site, and what happens if the project stalls all belong in the design agreement, and confusing the two documents leaves gaps in both.

Customer data deserves particular care. Where a designer can see enquiries, orders, or user accounts, personal data obligations apply independently of anything the two parties agree between themselves, and neither side can contract out of them.
This is the point that causes most friction, and it is entirely avoidable if raised early.
Designers need portfolios. Showing completed work is how they win the next client, and a blanket confidentiality clause that prevents it is a genuine problem for their business rather than a technicality to be waved through.
Clients sometimes need silence. An unannounced rebrand, a stealth product, or a competitive market may mean the work genuinely cannot be shown yet.
Agree the position up front. Whether the work may be shown, when, whether the client is named, whether a case study is permitted, and who approves it are all easy to settle at the start and awkward to argue about later.
A timed permission usually works. Allowing the designer to show the work after launch, or after a defined period, satisfies both sides in most cases and removes the awkward conversation entirely.
Tip: If you are the designer, raise portfolio rights before signing rather than asking for permission afterwards. If you are the client, saying yes with conditions costs you little and buys goodwill with someone holding your credentials.

Most problems on web projects come from access rather than from anyone repeating what they were told.
Create separate accounts rather than sharing passwords. Named access can be revoked without changing everything, and it shows who did what.
Grant the minimum needed. A designer building a landing page rarely needs full administrative access to the registrar or the advertising account, and narrowing it costs nothing.
Remove access at handover. Sites are frequently left with a former designer holding live credentials for years, and both sides forget until something goes wrong.
Change shared passwords when the project ends, and confirm in writing that copies have been deleted.
Agree who holds what after launch. Many clients have no record of where their site is hosted, which registrar holds the domain, or who can access the CMS, and discovering that during an outage is the worst possible moment.
Tip: Keep ownership of the domain and hosting accounts in the client’s name from the start. Sites registered under a designer’s account cause real difficulty if the relationship ends badly or the designer becomes uncontactable.

Several things people expect from a website design non-disclosure agreement belong somewhere else entirely.
Ownership of the finished site. Who owns the design, the code, and the content is settled in the design agreement, not here, and it should be addressed explicitly rather than assumed.
Licensed assets. Stock images, fonts, and plugins come with their own terms, and both parties should know what has been licensed, to whom, and whether the licence survives the end of the project.
Payment and scope. What happens if a project stalls, or if either side walks away mid-build, is a contract question.
Ongoing maintenance. Who holds credentials after launch, who is responsible for updates, and on what terms, should be written down rather than left as an informal understanding.
