What Is a Notary Acknowledgment in Nevada?

A Nevada notary acknowledgment records your declaration that you executed an instrument for the purposes stated in it. If you signed in a representative capacity, it also covers your authority and that you acted for the person or entity named. Chapter 240 of the Nevada Revised Statutes governs it.

Nevada Requirements for a Notary Acknowledgment

The Nevada Secretary of State appoints notaries under NRS Chapter 240.

Family Members

According to the Secretary of State, you can’t use a notary who is your spouse or related to you by blood. NRS 240.065 sets out the detailed rules.

Financial Interest

Under NRS 240.065, a notary also can’t act where they’ll receive a commission, fee, or other advantage directly from the transaction. The ordinary notarial fee is the exception.

Journal

Nevada notaries keep a journal under NRS 240.120. The Secretary of State notes that the document’s title and the signer’s name must go in it. So a notary can’t disguise a document with a false title to protect a client’s privacy.

How Much Can a Nevada Notary Charge for an Acknowledgment?

A Nevada notary acknowledgment costs up to $15 for the first signature of each signer (NRS 240.100). Each additional signature by that signer costs up to $7.50. Notaries may require payment in advance.

However, travel is where costs add up. A notary can charge extra for traveling only if all of these apply:

  • You asked the notary to travel
  • The notary explained that the fee is extra and not required by law
  • You agreed to the hourly rate in advance
  • The rate stays within $15 an hour between 6 a.m. and 7 p.m., or $30 an hour overnight

The notary may charge a two-hour minimum, then bill pro rata. If you cancel after the notary sets out, you may still owe the agreed travel fee. Fee limits change from time to time, so confirm the numbers when you book.

Tip

Check with your employer’s notary first. Nevada lets an employer bar its notaries from charging for work-related acts. So a notarization at your workplace may cost nothing.

How to Sign a Nevada Notary Acknowledgment

With the certificate ready, the appointment is brief.

  1. Choose the short form that fits how you’re signing.
  2. Agree on any travel fee and hourly rate before the notary sets out.
  3. Appear in person and declare that you signed the document.
  4. Next, the notary records the document’s title and your name in the journal.
  5. The notary completes and signs the certificate.
  6. Pay the fee, which may be requested up front.

What to Include in a Nevada Notary Acknowledgment

Nevada supplies separate short forms, so the first step is picking the right one:

  • NRS 240.166 — an acknowledgment in an individual capacity
  • NRS 240.1665 — an acknowledgment in a representative capacity
  • NRS 240.1667 — an acknowledgment containing a power of attorney
  • NRS 240.169 — an acknowledgment of a credible witness

Each short form works only when the notary complies with NRS 240.1655. Create your Nevada notary acknowledgment with Document Genius so the correct short form is filled in before you meet the notary.
