Free New Mexico Notary Acknowledgment Template

A New Mexico notary acknowledgment records a notarial act in which you appear in person and the notary identifies you. You then indicate that you signed voluntarily for the document’s stated purposes. If you signed for someone else, it also covers your authority. The Revised Uniform Law on Notarial Acts, NMSA 1978 §§ 14-14A-1 to 14-14A-32, governs it.

The New Mexico Secretary of State commissions notaries for four-year terms and publishes a Notarial Officer Handbook.

Automatic Notarial Officers

Commissioned notaries aren’t the only option, though. Judicial officers, court clerks, county clerks and deputies, Secretary of State staff, and attorneys licensed in New Mexico are automatic notarial officers. Each must complete training and register a stamp before acting.

Official Stamp

A notary public’s stamp uses 10-point font. It includes “State of New Mexico,” “Notary Public,” the notary’s legal name, commission number, and expiration date. Plus, it carries the New Mexico State seal. By contrast, an attorney’s stamp reads “Notarial Officer” and shows their state bar number instead.

Journal

Also, every notarial officer keeps a journal and retains it for ten years after the last act. Attorneys, though, only need one for acts unrelated to an established attorney-client relationship.

Fees

A notary may charge up to $5 per acknowledgment. Electronic acts can carry a technology fee of up to $25. However, a notary may add a travel fee only if you agree in advance and they explain it’s separate and not mandated by law. Fees may change, so confirm them before you go.

What a Notary Can’t Do

A notary can’t act on a blank or incomplete record. They also can’t notarize a record where they or their spouse or domestic partner is a party or has a direct beneficial interest.

Yes. The Secretary of State’s handbook reproduces the § 14-14A-15 short-form certificates in Spanish as well as English. For an individual, the Spanish version reads: “Este documento fue reconocido ante mi [fecha] por [nombre de la persona o de las personas].”

That’s useful for Spanish-speaking signers and families. Either way, each version sits under “Estado de” and “Condado de” venue lines. It then ends with the officer’s signature, official seal, and title of office.

Even so, think about where the document is headed. Before choosing a version, ask the recipient whether it accepts a Spanish certificate.

Here’s what to expect at the appointment.

1. Choose the individual or representative short form, in English or Spanish.
2. Complete every blank on your document before you arrive.
3. Bring identification the notary can rely on.
4. Tell the notary you signed voluntarily for the document’s stated purposes.
5. Next, the notary logs the notarization.
6. The notary signs the certificate, adds the title of office, and applies the official stamp.

In English, the short form for an individual uses this sentence: “This instrument was acknowledged before me on [date] by [Name(s) of individual(s)].” So a New Mexico notary acknowledgment built on § 14-14A-15 includes:

• “State of” and “County of” headings
• The date and each signer’s name
• The officer’s signature
• The officer’s official stamp
• The title of office

When you sign for someone else, the form also names your type of authority, such as officer or trustee, and the party you represent. Start your New Mexico notary acknowledgment with Document Genius and bring the completed form to your notary.
