A postnup is not the same as a divorce agreement. A postnup plans ahead, while divorce documents are used when you’re actively ending the marriage.

Spouses often create a postnup when they:

If you’re planning for separation or divorce right now, a postnup may not match your situation. In that case, a separation agreement or divorce agreement is usually a better fit.

Postnuptial agreements can be enforceable, but courts often review them closely. In general, the agreement is stronger when it’s voluntary, fair, and based on complete financial disclosure.

While rules vary by state, many courts look for signs that both spouses:

• Signed voluntarily, without pressure
• Had enough time to review the terms
• Fully disclosed assets, debts, and income
• Agreed to terms that are reasonable for both sides

If you live in a community property state, property rules can affect how assets and income are treated.

• Taxes: Whether you plan to file jointly or separately, if you want that stated
• Disability or death: Any support expectations, or property plans if one spouse passes away

A postnup usually cannot make binding decisions about child custody or child support. Courts typically decide those issues based on the child’s best interests at the time of separation.

A postnup also should not include terms that are illegal, coercive, or clearly against public policy. If a clause or the entire agreement is extreme or one-sided, a court may refuse to enforce it.

You can create a postnup at any point during the marriage. However, timing can still matter in practice. If you wait until there’s major conflict, it may be harder to show the agreement was voluntary and fair.
