What Is a Power of Attorney in Alabama?

A power of attorney is a legal document that allows you (the principal) to give another person (the agent or attorney-in-fact) the authority to act on your behalf. Depending on the type, your agent can manage your finances, make medical choices, or handle specific legal matters.

Under Alabama Code § 26-1A-104, all power of attorney forms are durable by default—meaning they remain valid even if you become incapacitated, unless the document states otherwise. The principal, agent, and any witnesses must be at least 19 years old when signing.

How to Write a Power of Attorney in Alabama

Follow these steps to create a valid and effective Alabama power of attorney:

  1. Name your agent: Include your full name, your agent’s name, address, and contact details. You can also name a co-agent or successor agent under AL Code § 26-1A-111.
  2. Define their powers: Specify what your agent can do—such as manage bank accounts, sign contracts, or make medical choices.
  3. Add limitations: Clearly state any actions your agent is not allowed to perform.
  4. Set how long it lasts: Decide whether the POA will remain in effect indefinitely, end on a set date, or only take effect upon incapacity (for springing POAs).
  5. Sign before a notary or witnesses: Alabama law (AL Code § 26-1A-105) requires the principal to sign before a notary or two disinterested adult witnesses.
  6. Distribute copies: Provide signed copies to your agent and relevant parties such as financial institutions or health care providers.

Legal Considerations in Alabama

  • Duration: A durable power of attorney stays valid until revoked or upon your death, unless it is specifically non-durable (AL Code § 26-1A-109). You can include an expiration date if it’s only needed temporarily—for example, during military deployment or extended travel.
  • Revocation: You can revoke your POA at any time by:
    • Delivering written or verbal notice to your agent (the revocation takes effect once received).
    • Creating a new POA and clearly revoking the prior one.
    • Divorcing an agent who is your spouse, unless the document states otherwise.
  • Filing: Most Alabama POAs don’t need to be filed, except those involving real estate, which must be recorded with the county land records office.
  • Notarization: For most forms, notarization is required, though two adult witnesses can substitute in certain cases. Witnesses must be disinterested parties—meaning they are not related to you by blood or marriage.
