What Is a Power of Attorney in Alaska?

A power of attorney is a legal document that allows one person (the principal) to authorize another (the agent or attorney-in-fact) to act on their behalf. Your agent can manage your finances, handle property, or make medical choices according to your instructions.

Under AK Stat § 13.26.600, the principal must sign and date the document before a notary public for it to be valid. The principal must also be at least 18 years old and mentally competent. Unlike most states, Alaska POAs are non-durable by default, meaning they end if you become incapacitated—unless you specifically include a durability clause under AK Stat § 13.26.620.

How to Write a Power of Attorney in Alaska

Follow these steps to create a valid and enforceable Alaska power of attorney:

  1. Name your agent: Include your full name, your agent’s legal name, address, and contact details. You may also name a co-agent or successor.
  2. Define their powers: Specify what your agent can do—such as managing bank accounts, property, or business matters.
  3. Grant special authority: Under AK Stat § 13.26.665, certain powers like gifting or changing beneficiaries must be clearly authorized in writing.
  4. State if it’s durable: To keep your POA valid after incapacity, include a statement of durability under AK Stat § 13.26.620.
  5. Sign before a notary: Alaska requires all POAs to be signed and dated before a notary public (AK Stat § 13.26.600). Witnesses aren’t required but can help prevent disputes.
  6. Distribute copies: Provide signed copies to your agent, your bank, and any organizations that need proof of authority.

Legal Considerations in Alaska

  • Duration: A durable POA remains valid until revoked or upon your death. A minor child POA lasts up to one year unless renewed or extended during military deployment (AK Stat § 13.26.066).
  • Revocation: You can revoke your POA at any time by completing a written revocation form or sending a signed notice to your agent. It becomes effective once your agent receives it.
  • Filing: Most Alaska POAs don’t need to be filed, except those involving real estate, which must be recorded with the county land records office.
  • Restrictions: Under AK Stat § 13.26.665, agents can’t alter estate plans, change beneficiaries, or make large gifts unless explicitly authorized.
  • Notarization: Alaska requires all POAs to be notarized. While witnesses aren’t mandatory, using two disinterested witnesses adds extra protection.
