What Is a Power of Attorney in Arizona?

A power of attorney allows a principal (you) to appoint an agent (or attorney-in-fact) to make decisions on your behalf. The document can grant limited or broad powers depending on your needs.

Under AZ Rev Stat § 14-5506, a POA is valid only if the principal is at least 18 years old and mentally competent. If the principal cannot understand the agreement’s purpose or consequences, the POA is not legally binding. Most Arizona POAs also require notarization and one qualified witness per AZ Rev Stat § 14-5501.

How to Write a Power of Attorney in Arizona

Follow these steps to create a valid Arizona power of attorney:

  1. Identify the principal and agent: Include full names, addresses, and contact details for all parties.
  2. Grant specific powers: Define exactly what the agent can do, such as managing finances, property, or healthcare.
  3. Add limitations: Clearly state which powers are excluded.
  4. State durability: If you want your POA to remain valid during incapacity, include a clause making it durable; otherwise, it ends when you lose capacity. Powers of attorney are not durable by default in Arizona, meaning you must include specific language if you want it to survive your incapacity.
  5. Select the effective date: Choose whether it starts immediately or after a triggering event, such as incapacitation. Unless stated otherwise, the POA is presumed to become effectve once it is signed.
  6. Sign and notarize: Arizona requires your POA to be signed, dated, and notarized, plus one witness who meets the eligibility rules under AZ Rev Stat § 14-5501.
  7. Distribute copies: Give signed copies to your agent, relevant institutions, and anyone needing proof of authority.

Legal Considerations in Arizona

  • Capacity: A POA is only valid if the principal understands its purpose and effects (AZ Rev Stat § 14-5506).
  • Execution: Most POAs need both notarization and one adult witness who isn’t the agent, the agent’s family member, or the notary (AZ Rev Stat § 14-5501).
  • Medical POAs: Must meet the signing rules in AZ Rev Stat § 36-3221 and may include instructions for treatment or attach a living will.
  • Recording for Real Estate: Any POA granting authority to manage real property must be filed with the local county recorder before a transaction.
  • Revocation: You can revoke your POA anytime with a signed notice or new POA that explicitly cancels the previous one (AZ Rev Stat § 14-5504). The agent’s authority ends once they receive actual notice of the revocation.
