How to Write a Power of Attorney in Arkansas

Follow these steps to create a valid Arkansas power of attorney:

  1. Name the principal and agent: Include the full name, address, and contact information for each party. You can appoint co-agents or successor agents under AR Code § 28-68-111.
  2. Grant authority: Specify which powers your agent will have—such as managing property, investments, or medical decisions.
  3. Add specific powers: Note whether your agent can handle trusts, gifts, or beneficiary designations.
  4. Choose the type: Decide whether the POA will be durable (remains valid if you’re incapacitated) or non-durable (ends if you are). If no language is included, the document is durable by default.
  5. Include supporting documents: Attach any related forms, such as a living will, advance directive, or agent authorization letter.
  6. Sign and notarize: Arkansas law (AR Code § 28-68-105) requires the principal to sign in front of a notary public.
