What Is a California Power of Attorney?

A California power of attorney (POA) lets you authorize someone you trust (your “agent”) to handle financial, medical, or legal matters for you. You must be at least 18 and of sound mind; California defines unsound mind in civil law (see CA Civ Code § 39).

To stay in force during incapacity, a POA must expressly state that it is “durable” (see CA Prob Code § 4124). Execution requirements are set out in CA Prob Code § 4121 (notary or two witnesses).

Types of Powers of Attorney in California

How to Write a Power of Attorney in California

  1. Name the principal and agent: List legal names, addresses, and contact info for you and your agent.
  2. Define authority: Check the powers you want to grant (banking, property, taxes, health care, etc.).
  3. Add limits and special instructions: Spell out any restrictions, gifting limits, beneficiary changes, or trust powers.
  4. Choose durability and timing: State whether the POA is durable or non-durable, and whether it’s effective now or “springing” on a trigger (see CA Prob Code § 4124 for durable language).
  5. Sign with proper formalities: Execute before a notary or two witnesses per CA Prob Code § 4121; health-care directives follow § 4673–§ 4675.
  6. Distribute and store: Give copies to your agent and any institutions that will rely on it (banks, providers). Keep the original in a safe, accessible place.

California Power of Attorney Requirements & Legal Considerations

Notarization

A POA must be acknowledged before a notary or signed by two adult witnesses (see CA Prob Code § 4121).

Health-care directives follow § 4673 and require a patient advocate/ombudsman signature for nursing-facility residents under § 4675 (see also § 4674). If your POA will be recorded for real estate, notarization is required for recording.

Filing

Most POAs don’t need to be filed with the court. For real estate transactions, record the POA (or a certified copy) with the county recorder where the property is located so your agent’s authority appears in the land records.

Revocation

You can revoke a POA at any time by providing notice under CA Prob Code § 4153. The agent may rely on the POA until they receive actual notice of revocation, so deliver notice promptly.

If your spouse is the agent, divorce automatically revokes their authority unless the POA states otherwise (CA Prob Code § 4154).
