What Is a Connecticut Power of Attorney?

A Connecticut power of attorney (POA) lets you (the principal) authorize another person (the agent or attorney-in-fact) to act for you in financial, legal, or medical matters. People use POAs to prepare for incapacity, complete real estate or vehicle transactions, manage banking and taxes, or make healthcare choices when they can’t speak for themselves.

The principal must be mentally competent at signing. Under the Connecticut Uniform Power of Attorney Act, statutory POAs are durable by default unless the document says otherwise (see CT Gen Stat § 1-350c).

Durable vs. Non-Durable Power of Attorney

By default, a Connecticut POA is durable—it continues to be effective if you become incapacitated (CT Gen Stat § 1-350c). To make it non-durable, the document must clearly state it ends upon incapacity.

Legal Requirements and Considerations for Connecticut POAs

You must meet certain execution rules for a POA to be enforceable in Connecticut. The principal must sign (or direct someone to sign in their conscious presence), and two witnesses must observe the signature (CT Gen Stat § 1-350d). Having the document acknowledged before a notary creates a presumption of genuineness.

Duration

Your POA can last indefinitely (often until the death of the principal or agent) or for a defined period/purpose. For task-specific POAs (e.g., resolving a tax issue), the document can end once the task is completed.

Termination

A Connecticut POA can terminate under any condition listed in CT Gen Stat § 1-350i, including: the principal or agent dies; the agent becomes incapacitated or resigns; the purpose is accomplished; a stated condition occurs; the principal revokes; or a court orders termination.

Revocation

You can revoke a POA at any time. Sign and date a revocation that states its effective date, then deliver copies to your agent and any institutions relying on the POA. Your agent may continue to act until they receive notice of the revocation.

Filing

While POAs don’t generally need to be filed, you may need to record a real estate POA with your local town clerk. It can also be helpful to provide copies to banks, hospitals, schools, and other institutions that will rely on the document.
