What Is a Florida Power of Attorney?

A Florida power of attorney (POA) lets you appoint a trusted person (the agent or attorney-in-fact) to make legal, financial, or medical decisions on your behalf. The person granting authority is called the principal.

Florida law requires the principal to be at least 18 years old and of sound mind when signing a POA (Florida Statutes § 709.2104).

A POA is often used for:

  • Financial management, like paying bills or handling investments.
  • Real estate transactions or property transfers.
  • Health care decisions when you’re unable to communicate.

Under Florida Statutes § 709.2108, Florida does not recognize springing powers of attorney (those that take effect only upon incapacity). The document becomes effective immediately unless otherwise limited.

Types of Power of Attorney in Florida

Each POA type serves a specific purpose. The table below outlines the main types, what they do, and the signing or notarization requirements.

How To Write a Power of Attorney in Florida

You can create a valid Florida POA without hiring a lawyer. Follow these steps:

  1. Identify the principal and agent: Include each person’s full legal name, address, and contact details. You may also name co-agents or successor agents (§ 709.2111).
  2. Define authority: Specify the powers you want your agent to have, such as managing property, finances, or healthcare decisions.
  3. Decide on durability: If you want your POA to stay valid after you become incapacitated, include language making it durable as defined in § 709.2104. Powers of attorney are not durable by default in Florida.
  4. Add special instructions: Limit or expand your agent’s powers. For example, you can restrict gift-giving or require co-agent approval for major actions.
  5. Sign and notarize: Florida law requires the principal to sign in front of two witnesses and a notary public (§ 709.2105).

Legal Requirements and Considerations in Florida

Notarization and Witnesses

Every Florida POA must be signed before two witnesses and a notary. This applies to both durable and non-durable forms. Without proper execution, the document is invalid under § 709.2105.

Agent Qualifications

Your agent must be at least 18 years old and capable of understanding the duties assigned. You can name co-agents or successor agents under § 709.2111.

Filing and Recording

You generally don’t need to record a POA. However, real estate POAs must be recorded in the county clerk’s office where the property is located, per § 695.03.

Revocation

You can revoke your Florida POA at any time by signing a written revocation and notifying your agent and any institutions that rely on it. The revocation becomes effective upon notice (§ 709.2110). Any acts taken before notification generally remain valid.

Termination

Under § 709.2109, a POA ends if:

  • The principal or agent dies.
  • The principal revokes it.
  • The principal becomes incapacitated if the POA is non-durable
  • The purpose of the POA is fulfilled.
  • A court declares it invalid.
  • The agent resigns and no successor is named.

If your spouse is your agent, the POA automatically terminates upon divorce unless otherwise stated.
