Free Alabama Non-Durable (General) Power of Attorney Form

Alabama treats every power of attorney as durable unless the document says otherwise. That default is why this version has to be written on purpose. An Alabama Non-Durable (General) Power of Attorney is a broad financial power of attorney stating plainly that your agent’s authority stops if you lose capacity. Section 26-1A-104 of the Code of Alabama is the reason: a power of attorney is durable unless it expressly provides that it is terminated by the incapacity of the principal.

Two things carry the weight here: the sentence that limits your agent, and the way you sign.

The Sentence That Stops Your Agent

Silence works against you in Alabama, because the law starts from durability. Your document has to expressly provide that it is terminated by your incapacity, in the language section 26-1A-104 uses. A loose phrase such as “this is temporary” does less work than a sentence tracking the statute, so mirror the wording rather than paraphrasing it.

Signing and Notarizing

Only one signature is needed, and it is yours. If you cannot sign, another individual may sign your name in your conscious presence and at your direction. Your signature is then presumed genuine once you acknowledge it before a notary public, or someone else authorized by law to take acknowledgments. Those rules are in section 26-1A-105, where notarization buys you a presumption rather than clearing a bare requirement.

There Is a State Form You Can Use

Alabama prints an optional power of attorney form at section 26-1A-301. It carries a notary acknowledgment block and a plain-language notice to the agent listing the events that end their authority. Using it is a choice, not a duty.

The authority ends, but a deal already done in good faith can still stand. Section 26-1A-110 lists incapacity as a terminating event for a power of attorney that is not durable. Subsection (e) then adds a qualification. Incapacity does not terminate the document as to an agent who acts in good faith without actual knowledge of it, and an act performed that way binds you and your successors in interest.

An Alabama Non-Durable (General) Power of Attorney is not a switch flipping the instant your capacity changes. Two habits follow. Tell your agent quickly when circumstances change, because their knowledge is what closes the window. Also track who holds a copy, since each of those people may still be working from the version they were handed.

Work through the document in order, and sign it last.

1. Name yourself as principal and your agent in full, with addresses.
2. Pick only the categories of authority you actually need.
3. Name a successor agent in case your first choice cannot serve.
4. Write the incapacity limit in language tracking Section 26-1A-104.
5. Add an end date, or tie the authority to a single task.
6. Sign it yourself, or direct someone to sign your name in your conscious presence.
7. Acknowledge your signature before a notary public.
8. Give the original to your agent, keep a copy, and note who else receives one.

Keep it narrow and specific. A workable Alabama Non-Durable (General) Power of Attorney carries:

• Your full name and address, and your agent’s
• The exact powers granted, and any you are withholding
• The sentence ending the authority on incapacity
• A start date, plus an end date or a defined task
• Your signature and the notary acknowledgment
