Free Connecticut Non-Durable (General) Power of Attorney Form

Connecticut asks for something most states do not, and it is easy to get wrong: two witnesses, every time. A Connecticut Non-Durable (General) Power of Attorney gives an agent broad authority over your financial affairs and ends if you lose capacity. The rules sit in the Connecticut Uniform Power of Attorney Act at chapter 15c of the General Statutes.

Connecticut packs the whole signing ceremony into two sentences, and they do different jobs.

Date It, Sign It, and Get Two Witnesses

Your document must be dated and signed by you, or signed in your conscious physical presence by another individual you direct to sign your name, and witnessed by two witnesses. The date and the two witnesses are not optional extras. They sit in the same sentence as the signature itself, in section 1-350d.

The Notary Is the Optional Half

The second sentence works differently. Your signature is presumed genuine if you acknowledge it before a notary public, a commissioner of the Superior Court, or another individual authorized by law to take acknowledgments. That is a presumption you earn, not a box you must tick. Connecticut reverses the pattern most states use, where the notary is required and witnesses are not. So a Connecticut Non-Durable (General) Power of Attorney needs both steps planned, not one.

Write In the Ending

Because the Act starts from durability, your document has to state expressly that it is terminated by your incapacity. Section 1-350c sets that position for documents created under the Act.

The two roles are separate, and Connecticut gives you a wider choice than most states on the second. Section 1-350d names three categories of officer who can take your acknowledgment: a notary public, a commissioner of the Superior Court, or another individual authorized by law to take acknowledgments. The commissioner option is a Connecticut feature worth knowing about, since it widens the pool of people who can complete the step.

Section 1-350e then handles validity across time and borders. A power of attorney executed in Connecticut on or after October 1, 2016, is valid if its execution complies with section 1-350d. One executed in the state before that date is valid if its execution complied with Connecticut law as it stood at the time. A document executed outside the state holds good here if it satisfied the law of the jurisdiction that determines its meaning and effect, or the federal requirements for a military power of attorney.

Under section 1-350e, unless the document says otherwise, a photocopy or electronically transmitted copy has the same effect as the original.

Line up the people before you fill anything in.

1. Write in your details and your agent’s, and add a successor agent.
2. Grant only the authority the task calls for.
3. State expressly that the document terminates on your incapacity.
4. Add an end date or describe the task that closes it.
5. Date the document. Connecticut puts the date in the statute alongside the signature.
6. Sign in front of two witnesses, or direct another individual to sign your name in your conscious physical presence.
7. Have both witnesses sign.
8. Acknowledge your signature before a notary public or a commissioner of the Superior Court.

A complete Connecticut Non-Durable (General) Power of Attorney shows:

• Your name and address, and your agent’s
• A successor agent, if you want a fallback
• The authority granted, and nothing wider
• The express sentence ending it on your incapacity
• The date of execution
• Your signature, two witness signatures, and an acknowledgment
