Free North Carolina Non-Durable (General) Power of Attorney Form

In North Carolina, how you cancel this document depends on something you may have done months earlier. A North Carolina Non-Durable (General) Power of Attorney gives an agent authority over your money and property and expressly ends that authority on your incapacity. Chapter 32C of the General Statutes, the North Carolina Uniform Power of Attorney Act, governs it.

North Carolina’s signing rule is two clauses long, and the second does more work than it looks.

Signed and Acknowledged

Your document must be signed by you, or in your conscious presence by another individual you direct to sign your name, and it must be acknowledged. Section 32C-1-105 numbers the acknowledgment as a requirement in its own right rather than only as a route to a presumption. It adds that a signature is presumed genuine if you acknowledge it before a notary public or other individual authorized by law to take acknowledgments. No witnesses are called for.

Put the Limit in Writing

A power of attorney created under the Chapter is durable unless it expressly provides that it is terminated by the incapacity of the principal. Section 32C-1-104 reversed North Carolina’s earlier position, so older documents and older guidance may start from the opposite assumption.

Which Documents the Chapter Covers

Section 32C-1-106 dates it. One executed in North Carolina on or after January 1, 2018 is valid if its execution complies with section 32C-1-105. One executed here before that date is valid if its execution complied with North Carolina law as it then stood. One signed in another jurisdiction is valid here if its execution met that jurisdiction’s law on meaning and effect, or the federal standard for a military power of attorney.

Section 32C-1-110 splits the question in two, and the fork is whether the document was registered with a register of deeds in North Carolina.

If it was registered, you revoke it by registering an instrument of revocation in that same office. The instrument must be executed and acknowledged by you while you are not incapacitated, and it must carry proof of service on your agent in the manner prescribed for service under Rule 5 of the North Carolina Rules of Civil Procedure. Telling your agent is not a side courtesy here; it is part of the mechanism.

If it was not registered, you have two routes. One is a subsequent written revocatory document, again executed and acknowledged while you are not incapacitated. The other is physical: the statute allows revocation by the document being burnt, torn, canceled, obliterated or destroyed, with the intent and for the purpose of revoking it, by you or by another person in your presence and at your direction, while you are not incapacitated. Few states still recognize destruction as a method for ending a North Carolina Non-Durable (General) Power of Attorney, and the statute spells out that intent is what makes it count.

Two related rules are worth knowing. Executing a new power of attorney does not revoke an earlier one unless the new document says the previous one is revoked, or that all other powers of attorney are revoked. And where a guardian of your estate or a general guardian is appointed, that guardian can terminate a registered power of attorney by registering an instrument of revocation, with proof of service on the agent.

1. Fill in your details and your agent’s, and name a successor.
2. Set out the authority granted, keeping it to what the task needs.
3. Write the express provision ending the document on your incapacity.
4. State whether any earlier power of attorney is revoked.
5. Add an end date or the task whose completion closes it.
6. Sign it yourself, or direct someone to sign your name while you watch.
7. Have the document acknowledged, which section 32C-1-105 requires in its own right.
8. Decide whether you need it registered with a register of deeds, and remember that choice governs how you revoke it later.

A complete North Carolina Non-Durable (General) Power of Attorney carries:

• Your name and address, and your agent’s
• Any successor agent
• The authority granted, itemized
• The express provision terminating it on your incapacity
• A statement about any earlier power of attorney
• An end date or defined task
• Your signature and the acknowledgment
